Dear Ms. Lincoln:
I have reviewed the above building permit application for the Planning Division, and it was found that the
following information, corrections, or clarifications will need to be addressed before review can continue:

Location
1.: As stated in the Engineering Division’s comment letter dated October 15, the City
cannot approve the proposed fence unless it is constructed in a location approved by Olympic View
Water and Sewer District.
Height
2.: You stated during a conversation at the counter that you would like to change your
proposal to a six foot fence on top of a two foot cement base. This would cause the top of the fence
to be eight feet above original grade. Pursuant to ECDC 17.30.000.C, unless a variance is first
obtained, no fence shall be more than six feet in height as measured from the top of the fence to the
lowest original grade. Thus, in order to construct a six foot fence on a two foot base, you would
need a variance. It should be noted that variances are difficult to obtain, as you would need to
prove to the Hearing Examiner that you meet all of the criteria of approval contained within ECDC
20.85.010. Additionally, the fee for a variance is approximately $1,500, review takes three to four
months, and approval is not guaranteed.
The only other option for additional height is that the code does allow for a decorative trellis up to
two additional feet in height to be added to a six foot fence (creating a combined height of a
maximum of eight feet above original grade) so long as the combined length of the trellis(es)
constructed facing a property line do not exceed 25 percent of the total length of that property line
(ECDC 17.30.035.C.1). Your site plan indicates that the western property line is 300 feet. Thus,
you could proposed to construct a two foot trellis on a six foot fence for a combined length of 75
feet adjacent to the western property line. The rest of the fence would be limited to a maximum of
six feet in height over original grade.
