Michele- Thanks for the response. I want to be clear about this
information. The land that was disturbed in fact had no plantings on it.
However, I understand and appreciate the City's concern with bare soil
[despite that that was its state prior!] We will certainly place some bark or
equivalent on the area. However, your email states: "...shall be replaced
with some form of permanent restoration, such as bark or mulch and ground
cover." Are you suggesting that we have to provide both some form of mulch
and ground cover, implying some form of living plant? Since we will not be
irrigating this area, what kind of living ground cover are you proposing which
will survive without irrigation? It does not seem feasible that the neighbors will
be providing irrigation to that area. Please clarify this issue as we are fast
approaching completion and need to decide how to meet your requirements.

The type III landscaping requirements per Edmonds Community Development
Code (ECDC) 20.13.030 south of the southern property boundary have been
waived and irrigation of any plantings south of the fence is not required.
However, any ground disturbance regarding the project which results in bare
soil shall be replaced with some form of permanent restoration, such as bark or
mulch and ground cover. When an applicant obtains a building permit to
perform site work the applicant is responsible to restore the disturbed areas.

Michele- Thanks for your response. I am still unclear as to whose
responsibility the landscaping is on the neighbor's [south side] of the fence
between the fence and sidewalk where I assume your comment
concerning "erosion control such as ground cover...." As well as the issue
of providing irrigation for whatever planting or ground cover is placed
there. From my experience elsewhere, including the placement of a fence
by my northern neighbor on the property line did not require them to
provide landscaping or other services on my side of the fence. Could you
please clarify this issue and the legal basis for any requirement for me to
provide any such services. This includes planting, irrigation and
maintenance of the area. I would appreciate you most rapid response to
this question. I would like to meet with you tomorrow if possible to clarify
and resolve these issues.

Thank you for your patience. In regards to your question about landscaping
requirements you may place a fence along the property line, however; all onsite
landscaping is still required, such as the rear side of the trash enclosure etc.
Additionally the area between the fence and sidewalk will need to contain some
kind of erosion control measures such as ground cover not just bare dirt.
