Since my last written correspondence with you, I have become aware of the 1982 nonexclusive
easements my client's predecessor in property ownership granted for the benefit of your clients
property. The nonexclusive easement allowed for the construction of the waterline crossing under
the west 12 feet of my client's property. The fire hydrant on your clients property receives water
from that line. Edmonds has also approved construction plans for my clients connection of a vault
and fire line serving their buildings new sprinkler system to the water line in the easement area. The
connection will have a double check value at the connection and not interfere with the water flow
to hydrant. There will be a brief shut down of the line for the connection to be made. Unless I hear
objection on or before October 12, 2018 my client will assume there is no objection and proceed
with the connection.

Since our email exchange I have learned from the City of Edmonds that the fire hydrant is actual on
the apartment house property and not on my client's property. Does your client have any records as
to the installation of the fire hydrant and the water line across my client's property feeding they
hydrant?

Here is how I understand the situation. Our client Northpoint has a pending application for a building
permit on their property at 7416 212th Street SW in Edmonds. There is a City waterline and fire
hydrant providing fire suppression service benefiting our client's property and your client's property.
Edmonds staff cannot locate any easement to the City for the infrastructure Northpoint will be
required to incorporate a fire sprinkler system in its new building which will be connected to the
existing water line via a water vault and back flow prevention. Edmonds maintains that because of
this connection Northpoint will be required to provide Edmonds with an easement acknowledging
Northpoint's ownership and maintenance responsibility for the existing waterline and fire hydrant
that services your client's property as well as the Northpoint property. The proposed easement
would grant Edmonds access rights for inspection, testing and use of the facilities for public fire
suppression Because the water line and fire hydrant benefit your client's property, the City of
Edmonds maintains that Northpoint has the option of working out a maintenance sharing
arrangement with the adjoining property owner and referencing or including the maintenance
arrangement in the easement. Such an agreement requires your client's cooperation and agreement
to share maintenance responsibilities for the mutually beneficial water line and fire hydrant. That is
why Northpoint has been reaching out to your client. If the water line and hydrant exist for the
mutual benefit of both properties, both properties should share the responsibilities for maintenance
of the infrastructure.
Can you be of assistance in working out a maintenance sharing agreement between you client and
Northpoint?
