Dear Applicant:
I have reviewed the above building permit application for the Planning Division, and it was found that the following
information, corrections, or clarifications will need to be addressed before review can continue:
Rockeries and Retaining Walls
1.: Your site plan indicates a landscaped area to the east of the proposed
addition. The site plan indicates something surrounding this landscaped area, but it is not labeled what it is.
It appears that it may be a curb (the symbol matches the curb around the carport posts), but I am not sure if it
could be a rockery or retaining wall. Please label this feature and indicate whether it is existing or proposed.
Also, if it is a proposed rockery or retaining wall, you will need to show that it does not exceed three feet in
height over original grade since it is located within the minimum required rear setback.
Topography:
2. Please provide topography at two-foot contours on all copies of your site plan.
Height Calculations
3.: Please confirm that the elevations used for Points A through D of your height
rectangle accurately represent the elevations of the original grade at these four points. When looking at the
elevations of the surveyed points on the site plan, it was noted that the elevations of Points A through D are
not in the same exact locations as these points, but the elevations are stated as being the same. For example,
Point A of the height rectangle is stated as being 101.7’; however, Point A is located approximately eight feet
west of the surveyed elevation of 101.7’ (located at the southeast corner of the porch).
Nonconforming Structure
4.: The existing residence exceeds the maximum allowed height of 25 feet for the
RS-12 zone. Pursuant to ECDC 17.40.020, a nonconforming structure may be maintained as long as it is not
altered in any way that expands the nonconformity; therefore, please refer to the questions below:
a.Your plans indicate that the existing roof will be replaced. Please confirm that the roof will be
replaced exactly as is and that the pitch of the roof of the overall height will not change. If a change
is proposed, we will need to review it for compliance with our nonconforming regulations.
b.The main floor plan indicates that the exterior of the chimney is proposed to be refaced. Please
provide information on what exactly is proposed to be done to the chimney. Is this a maintenance
activity and the main structure of the chimney will remain in place while just the surface is updated?
Or, will the chimney be torn down and rebuilt in a new material? If the proposed work on the
chimney is found to be more than ordinary maintenance and repair, the chimney will need to be
brought into compliance with current code requirements for height, which specify that chimneys less
than 9 square feet in horizontal section may not exceed the 25-foot height limit by more than three
feet (ECDC 21.40.030).
