Dear Ms. Bondurant:
I have reviewed the above building permit application for the Planning Division, and it was
found that the following information, corrections, or clarifications will need to be addressed
before review can continue:
Carport
1.: The minimum required setbacks for the RS-8 zone are measured from the
property lines as follows: Street = 25’, Sides = 7.5’, Rear = 15’. Based on the dimensions
provided on your site plan, the existing carport is located within the minimum required 7.5-
foot side setback from the western property line as well as the 25-foot street setback from
the southern property line. Edmonds Community Development Code (ECDC) 17.40.020
defines a nonconforming building as “one which once met bulk zoning standards and the
site development standards applicable to its construction, but which no longer conforms to
such standards due to the enactment or amendment of the zoning ordinance of the City of
Edmonds or the application of such ordinance in the case of a structure annexed to the
city.” If a structure is found to be nonconforming, it is subject to the nonconforming
regulations of ECDC 17.40, which include the allowance for maintenance of the structure
so long as it does not expand the extent of the nonconformity. However, structures built
without the proper permit required at the time of construction are not considered
nonconforming and cannot be maintained as such. Staff is unable to determine whether the
carport was legally constructed or if it was constructed without the required permits as it
was found that Snohomish County records do not indicate a permit for construction of the
carport. Please submit documentation of the carport being constructed to the standards and
with the permits required at that time, or remove any improvements to the carport from
your proposal. Staff cannot approve any work to be constructed to the carport unless it can
be shown that the carport was legally constructed.
All submittals should be made to a Development Services Permit Coordinator, Monday through
