RE: Request to Locate Tables and Chairs Within City Right -of -Way
Dear Mr. Peterson:
We have reviewed your encroachment permit application for tables and chairs in the City
right of way. As discussed with you previously, the City of Edmonds is currently in the
process of developing a new type of procedure to permit the use of City right-of-way by
private parties. After further review of your encroachment permit application, we have
found a way to allow you to place tables and chairs on the City sidewalk in the interim
while we develop our new type of street/right of way use permit.
The Edmonds Community Development Code (ECDC) Section 17.70.040, Bistro and
Outdoor Dining, allows for temporary use of public sidewalks in right of way areas
immediately adjacent to a licensed food or beverage service establishment. The City of
Edmonds will allow you to place tables and chairs on the sidewalk in front of your
establishment, in accordance with ECDC 17.70.040, with the condition that, as the owner
of Olive's Gourmet Foods, you will apply for and obtain a permit, and pay the associated
fees within 30 days of establishment of the City's new permit procedure. As part of the
approval criteria, you will be required to maintain the following:
1. Provide for safe pedestrian travel on the sidewalk. Maintain a clear zone of 44 inches
minimum.
2. Maintain clear landings on the exterior side of all required exit doors of 44 inches or
no less than the width of the door, measured toward the street.
3. Maintain three feet of clearance around fire hydrants, standpipes, manholes, water
meters, blowoffs, cleanouts and valves.
We believe this will be much simpler for you in the long run, will comply with City code,
and will be more appropriate for your planned use of the sidewalk than an encroachment
permit.

will submit an application for the new type of street/right of way use permit as soon as
the procedures are developed. Upon your signature below, this letter constitutes the
City's interim approval for you to place tables and chairs on the City sidewalk
immediately adjacent to your establishment.
We apologize for any inconvenience this process may have caused you. The City will
refund the $178.00 fee you paid with your encroachment permit application. If you have
