Special circumstances include the size, shape, topography, location or surroundings
of the property and public necessity for public structures.
In this case, the applicant wants to exceed the maximum permissible sound levels
between the hours of 10:00 p.m. and 7:00 a.m. for the purpose of performing street
improvements. The applicant states that, "Night work will be used in situations that
would otherwise cause substantial impacts to the convenience and safety of the
general public, and to public safety agencies (see Attachment 2)." Special
circumstances exist therefore, due to the public necessity for improvement to public

property shall be as set forth in the following table:

5.30.050 Modification to maximum permissible sound levels.
The maximum permissible sound levels established by this chapter shall be reduced or increased by the
t
sum of the following:
A. Between the hours of 10:00 p.m. and 7:00 a.m. the noise levels shall be reduced by 10 dB(A) for
t
receiving property within residential districts, except for noise from electrical substations and existing,
stationary equipment used in conveyance of water by a utility.
B. At any hour of the day or night, the applicable noise levels may be exceeded for any receiving
property by no more than:
1.5 dB(A) for a total of 15 minutes in any one hour period, or
2. 10 dB(A) for a total of five minutes in any one hour period, or
3. 15 dB(A) for a total of 1.5 minutes in any one hour period. [Ord. 2531,1985; Ord. 2193 § 6,1981].
5.30.120 Variances.
A. Variances may be granted to any person from any requirement of ECC 5.30.040 if findings are made
that immediate compliance with such requirement cannot be achieved because of special circumstances
rendering iminediati compliance unreasonable in light of economic or physical factors, encroachment
£
upon an existing noise source or because of nonavailability of feasible technology or control methods.
B. Any such variance or renewal thereof shall be granted only for the minimum time period found to be
necessary under the facts and circumstances.
C. Variances shall be.heard and decided in the manner as set forth in the Edmonds Community
?� '
Development Code for land use variances.
D. The grant of a variance shall not relieve any person from the requirements of ECC 5.30.130 relating
to public disturbance noises. [Ord. 2531,1985; Ord. 2193 § 13,1981].

Request for Extension
On May 29, 1996, the Washington State Department of Transportation (WSDOT) was
granted a varianpe from noise standards for the subject project. Due to funding delays this
project was not built during the 1996 summer construction season. Construction will now
occur between April and August of 1997.
In a telephone call to John Bissel of the City of Edmonds on September 27, 1996, Joanne
Welty of this office was informed that the variance would be good until May 29, 1997.
She was'aIso told that we could request at variance extension. Therefore the WSDOT
hereby requests an extension of the Variance from Noise Standards, case number V-96-
48, granted May 29, 1996.
As before, the main items of work include overlaying SR 104 from milepost 25.81 to
milepost 27.53, grinding, paving, adjusting drainage, and channelization. The WSDOT
proposes that nighttime work hours be utilized in the grinding and paving of the area from
milepost 26.13 to milepost 26.53 to avoid impacting business there. This area runs
approximately from 102nd Ave. W to 97th Ave. W. Lane closures will take place
between the hours of 7:00 PM to 5:00 AM. Night work is expected to last a total of 15
days.
We anticipate that the construction equipment to be used will include asphalt pavers,
dump trucks, water truck, sweeper truck, tack truck, roller compactors, jack hammers, air
compressors, and a pavement grinder/planer.
We propose the following measures to minimize noise:
a. No impactor impluse tools or pavement grinding after midnight, except for in
designated areas.
LOCATION: SR 104 from Mile Post 26.13 (102nd Avenue West) to Mile Post
26.53 (97th Avenue West) (see Exhibit A, Attachments I and 3).
APPLICATION: TION: A variance to exceed the maximum permitted noise limit of 45 dBA
from 10:00 PM to 7:00 AM for a temporary duration to allow for
the completion of a paving overlay of State Route 104 between
approximately 102nd Avenue West (mile post 26.13) and 238th
Street Southwest (mile post 26.53) for a temporary period of
approximately 15 days beginning on or about July 1, 1996 (see
Exhibit A, Attachment 1).

final decision.

After reviewing the official file which included the Planning Division Staff Advisory Report; and
after visiting the site, the Hearing Examiner conducted a public hearing on the application. The
hearing on the Washington State Department of Transportation application was opened at 9:21
a.m., May 16, 1996, in the Plaza Room, Edmonds Library, Edmonds, Washington, and closed at
9:25 a.m. Participants at the public hearing and the exhibits offered and entered are listed in this 1
report. A verbatim recording of the hearing is available in the Planning Division. ¢

HEARING COMMENTS:
The following is a summary of the comments offered at the public hearing.

Dirk Vinish, Planner, reviewed the staff report and recommended approval with
conditions.
From the Applicant:
Joanne Welty, WSDOT representative, said the Department is requesting.the 15 day noise
variance to allow for the completion of a paving overlay of a portion of SR 104.
From the Community:
No one from the community spoke at the hearing.
FINDINGS OF FACT AND CONCLUSIONS
A. SITE DESCRIPTION
1. Site Development And Zoning:
a. Facts:

1) Site Characteristics: SR 104 from Mile Post 26.13 (102nd Avenue
West) to Mile Post 26.53 (97th Avenue West) (see Exhibit A,
Attachments 1 and 3).
2) Terrain and Vegetation: The subject property slope varies, generally
it slopes from the east to west with most open areas landscaped (see
Exhibit A, Attachment 4).
2. Neighboring Development And Zoning:
a. Facts:
1) North: Developed with commercial businesses and zoned
Neighborhood Business (BN).
2) South: Developed with commercial businesses and multifamily
residences and zoned Neighborhood Business (BN).
3) East: Developed with SR 104.

B. STATE ENVIRONMENTAL POLICY ACT (SEPA)
1. Eget: The application is exempt from SEPA pursuant to WAC 197-11-800(1)(b)(i).
2. Conclusion: The City and the applicant have satisfied the requirements of SEPA.
C. EIDMONDS COMMUNITY DEVELOPMENT CODE (ECDC) COMPLIANCE
1. Compliance with requirement for a Variance
ECDC Chapter 20.15B.180.A, states an applicant may request a variance from the
standards of this Chapter pursuant to the procedures set forth in ECDC Chapter 20.85
(Variances). Chapter 20.85 of the ECDC sets forth the mechanism whereby a
provision of the Code may be varied on a case -by -case basis if the application of the
provision would result in an unusual and unreasonable hardship (see Exhibit A,
Attachment 2). ECC 5.30.120 Variances states, variances may be granted to any
person from any requirement of ECC 5.30.040 (maximum permissible sound levels), if
findings are made that immediate compliance with such requirement cannot be
achieved because of special circumstances rendering immediate compliance
unreasonable in light of economic or physical factors, encroachment upon an existing
noise source or because of nonavailability of feasible technology or control methods.
2. Eacts:
a. ECDC Section 20.85.010 establishes the decisional criteria with which a variance
request must comply in order to be granted by the Hearing Examiner. These
criteria include: a special circumstance must exist; no special privilege is granted;
the proposal is consistent with the Comprehensive Plan and the Zoning Code; the
proposal will not be detrimental and is the minimum necessary.
b. Variances may be used to modify bulk standards. They may not be used to modify
use or procedural requirements.
c. ECC Section 5.30.040 Maximum permissible sound levels states, "The maximum
permissible sound level as measured at the property line or anywhere within the
receiving property shall be as set forth in the following table: Residential 55
dB(A)..." (see Exhibit A, Attachment 5).
d. ECC Section 5.30.050 Modification to maximum permissible sound levels, states,
"Between the hours of 10:00 p.m. and 7.00 a.m. the noise levels shall be reduced
by 10 dB(A) for receiving property within residential districts..." (see Exhibit A,
Attachment 5).
3. Conclusions•
a. Special Circumstances
Special circumstances include the size, shape, topography, location or
surroundings of the property and public necessity for public structures.

In this case, the applicant wants to exceed the maximum permissible sound levels
between the hours of 10:00 p.m and 7:00 am for the purpose of performing
street improvements. The applicant states that, "Night work will be used in
situations that would otherwise cause substantial impacts to the convenience and
st fety of the general public, and to public safety agencies (see Exhibit A,
Attachment 2)." Special circumstances exist therefore, due to the public necessity
for improvement to public roads.
h. SgMial Pftilene
It does not appear that any special privilege will be demonstrated in granting this
variance in that other properties in the same zone with similar circumstances would
also qualify for a variance (see Exhibit A, Attachment 2).
c. Zoning, Code and the Comprehensive Flan
Approval of the proposed variance would allow for the continued development of
the site in a manner consistent with the intent of the Zoning Code and the
Comprehensive Plan designation of the site (see Exhibit A, Attachment 2).
d. Not Detrimental
Adjacent property owners appear to have similar development on their property.
Approval of the variance would not be detrimental to the public health, safety or
welfare (see Exhibit A, Attachment 2).
e. Minimum Required
The request is the minimum necessary for constructing the road system
improvements (see Exhibit A, Attachments 2 and 4).
D. TECHNICAL COMMITTEE
1. Fact: No comments were submitted by other departments.
E. COMPREHENSIVE PLAN (ECDC)
1. Fact: The subject property is designated as the "Edmonds Way Corridore'.
2. Conclusion: The proposed development is consistent with the existing
Comprehensive Plan Land Use designation for the site.
DECISION
Based upon the foregoing findings and conclusions, the requested variance from noise standards is
approved, subject to the following conditions.
1. This variance is to allow noise to exceed the standard in the locations identified on the
proposed site plan (see Exhibit A, Attachment 4).
2. The permit shall not be transferable.

decision by any person who attends the public hearing and signs the attendance register and/or
presents testimony, or by any person holding an ownership interest in a tract of land which is the
subject of such decision or recommendation. The reconsideration request must cite specific
references to the findings and/or the criteria contained in the ordinances governing the type of
application being reviewed.
B. APPEALS:
Section 20.105.020.A & B describe how appeals of a Hearing Examiner decision or
recommendation shall be made. The appeal shall be made in writing, and shall include the
decision being appealed along the name of the project and the date of the decision, the name of,
the individual or group appealing the decision, their interest in the matter, and reasons why the
appellant believes the decision to be wrong. The appeal must be filed with the Community
Development Director within ten (10) working days after the date of the decision being appealed

property shall be as set forth in the following table;

5.30.050 Modification to maximum permissible sound levels.
The maximum permissible sound levels established by this chapter shall be reduced or increased by the
sum of the following;
A. Between the hours of 10:00 p.m. and 7:00 am. the noise levels shall be reduced by 10 dB(A) for
receiving property within residential districts, except for noise from electrical substations and existing
stationary equipment used in conveyance of water by a utility.
B. At any hour of the day or night, the applicable noise levels may be exceeded for any receiving
property by no more than:
1.5 dB(A) for a total o€15 minutes in any one hour period, or
2. 10 dB(A) for a total of five minutes in any one hour period, or
3. 15 dB(A) for atotal of 1.5 minutes in any one hour period. [Ord. 2531, 1985; Ord. 2193 § 6, 1981].
5.30.120 Variances.
A. Variances may be granted to any person from any requirement of ECC 5.30.040 if findings are made
that immediate compliance with such requirement cannot be achieved because of special circumstances
rendering immediate compliance unreasonable in light of economic or physical factors, encroachment
upon an existing noise source or because of nonavailability of feasible technology or control methods.
B. Any such variance or renewal thereof shall be granted only for the minimum time period found to be
necessary under the facts and circumstances.
C. Variances shall be.heard and decided in the manner as set forth in the Edmonds Community
Development Code for land use variances.
i D. The grant of a variance shall not relieve any person from the requirements of ECC 5.30.130 relating

The Washington State Department of Transportation (WSDOT) proposes to overlay SR I
104 from Milepost (NP) 25.81 to MP 27.53.
i
This project is scheduled to be advertised on June 1, 1996. Construction could begin as
early as July 1, 1996 and be completed by the beginning of October of 1996.
The main items of work include overlaying SR 104 from MP 25.81 to MP 27.53. This
will involve grinding, paving, adjusting drainage and channelization. As requested in a
letter (1/12/96) from Gordon C. Hyde, Engineering Coordinator City of Edmonds, the
WSDOT proposes that nighttime work hours be utilized in the grinding and paving of the
area from MP 26.13 to MP 26.53 to avoid impacting business there. This area runs
approximately from 102nd Ave. W to 97th Ave. W. Lane closures will take place
between the hours of 7 PM to 5 AM. Night work is expected to last a total of 15 days.
We anticipate that the construction equipment to be used will include asphalt paver(s),
dump trucks, water truck, sweeper truck, tack truck, roller compactor(s), jack hammers,
air compressors, and a pavement grinder/planer.
We propose the following measures to minimize noise:
a. No impact or impulse tools or pavement grinding after midnight, except for in
designated areas.
b. Rubber bed liners for export trucks.
