PATIO REPLACEMENT AND RETAINING WALL AT 505 PARADISE LANE
Dear Mr. Bodine,
I have again reviewed the above building permit application for the Planning Division. Thank
you for submitting the updated geotechnical report from Nelson Geotechnical Associates.
Before I can sign off on the permit, however, the following information needs to be clarified in a
written response:
Patios, steps, decks: According to ECDC 16.20.040.C, "[u]ncovered and unenclosed
porches, steps, patios, and decks may project into a required setback not more than one-
third of the required setback, or four feet, whichever is less...." As proposed, the new
patio and steps are shown located within the required 5' side setback on the western
edge of your property. At most, the patio and steps can encroach the setback area 1.66
feet (1/3 of 5 feet). Please revise the site plan as appropriate.
Because this hermit is in response to a violation, please submit three copies of your updated site
plan and two sets of any updated sheets of the building plans by June 10, 2011. If your response
is not received by that date, your file will be forwarded to Code Enforcement. Please make all
submittals to a Permit Coordinator, Monday through Friday, 8:00 am to 4:30 pm. If you have
