You state that you are abandoning plans for the proposed retaining wall along the top of the slope to the north of your house. It is my understanding that the northwest portion of the proposed wall was to support the proposed patio, as is indicated on the Improvements Site Plan from the NGA geotechnical report (enclosed). Without at least that portion of the retaining wail, the patio and steps portion of your project would not be able to be permitted and would have to be removed. You also state that the "patio and sidewalk" had been previously approved. I am not sure what sidewalk you are referring to — the current application is for a patio, steps and a retaining wall. You received a building permit in 2009 for foundation replacement but that did not permit the patio replacement nor the steps proposed in this permit. As explained in my letter of May 23, 2011, your site requires a 5 -foot side setback where no structures are allowed except minor improvements less than 36 inches in height. There is a setback exception for patios, steps and decks in ECDC 16.20.040.0 but your site plan does not show the patio and steps meeting that requirement (enclosed). Until you provide a true and accurate site plan showing the patio and steps meeting the required 5' side setback for the zone (or the setback exception mentioned above), I cannot sign off on your permit. Because this permit is in response to a violation, please submit three conies of vour updated site plan and two sets of any updated sheets of the buildinglap ns by .Tune 29, 2011. If your response is not received by that date, your file will be forwarded to Code Enforcement. Please make all submittals to a Permit Coordinator, Monday through Friday, 8:00 am to 4:30 pm.
