SW Dear Mr. and Mrs. Gillis: I have reviewed your resubmittal received on May 20, 2011 for the above building permit application for the Planning Division, and it was found that the following information, corrections, or clarifications will need to be addressed before review can continue: Setbacks: The shortest distance between the northeast corner of the deck and the northern property line scales out on your revised site plan as approximately 12 feet. As stated in my previous comment letter, it will need to be shown that the new deck will comply with all minimum required setbacks, including the 15-foot rear setback from the northern property line. Edmonds Community Development Code (ECDC) 16.20.040.0 provides the following setback exception for single- family residences: "Uncovered and unenclosed porches, steps, patios, and decks may project into a required setback not more than one-third of the required setback, or four feet, whichever is less; provided, that they are no more than 30 inches above ground level at any point. " During our phone conversation on May 6th, you confirmed that the proposed deck will be less than 30 inches above ground level, and your building plans also indicate this fact; however, it is unclear if the deck is proposed to be enclosed in any way. If you are proposing a handrail, guardrail, or other enclosure around the deck, you will not be able to utilize the setback exception above, and the deck must be a minimum of 15 feet from the northern property line. If no handrail, guardrail, or other enclosure is proposed, the deck may extend into the 15-foot rear setback by four feet, thus reducing the rear setback for the deck to 11 feet. In order to show compliance with these requirements, please indicate the shortest distance from the deck to the northern property line (as measured perpendicular from the northern property line) and provide additional information on whether the deck is proposed to be enclosed by a handrail, guardrail, or other type of enclosure. All submittals should be made to a Development Services Permit Coordinator, Monday through Friday, between 8:00 am and 4:30 pm.
