Dear Mr. Krebs,
I have reviewed the above building permit application for the Planning Division. Before I can sign off on
the permit, however, the following information needs to be clarified in a written response:
1. Street setback: The RS-8 zone where your parcel is located requires a 25' setback from the
street property line to any structure. The proposed covered deck and addition off of the northwest
corner of your house is indicated to be 18' 7" from the street property line along 224'h Street SW
(it appears to match the line of the existing house). Unfortunately, I cannot approve that addition
as shown since the new construction does not meet the required 25' setback. However, the
Edmonds Community Development Code (ECDC) does allow some flexibility in this type of
situation.
ECDC 16.20.040.A states:
Average Front Setback. If a block has residential buildings on more than one-half of the
lots on the same side of the block, the owner of a lot on that block may use the average of
all the setbacks of the existing residential buildings on the same side of the street as the
minimum required front setback for the lot. Detached structures such as garages;
carports; and uncovered porches, decks, steps and patios less than 30 inches in height,
and other uncovered structures less than 30 inches in height shall not be included in the
"average front setback" determination.
An applicant for such a determination shall provide a drawing which locates the street
property line for the entire block, as well as the existing street setbacks of all buildings
required to be used far the purpose of calculating the "average front setback. " The
drawing shall be prepared and stamped by a land surveyor registered in the state of
Washington.
It would appear from the enclosed aerial photo that the two other houses on your side of the
block between 991h Ave. and 100'1' Ave. are located fairly close to their 2241h Street property lines.
Using the average front setback exception may well provide the distance you need. If you plan to
pursue this exception, please submit a survey as required in the code referenced above. A fee of
$130 will be charged for review of the exception as a separate staff decision.
