Dear Mr. Lybeck: I have reviewed the above building permit application for the Planning Division, and it was found that the following information, corrections, or clarifications will need to be addressed before review can continue: 1. Setbacks: The subject property is located within the RS-6 zone, which requires a minimum 15-foot rear setback from the southern property line. As indicated on your site plan, the proposed replacement deck is located well within this minimum required setback area. I reviewed the city's records for this property and was unable to find evidence that an original deck was legally constructed in this location. I am enclosing the building permit from 1960 for the residence (BLD19600020), which specified a 15-foot rear setback requirement at that time. If an original deck had been legally constructed, our nonconforming structure provisions of ECDC 17.40.020 would allow for its replacement in the same exact location as the original deck, without expanding it in any way. However, if the original deck was not legally constructed, it cannot be replaced due to its location within the minimum required rear setback area. Please submit sufficient evidence of the original deck being legally constructed and the replacement deck being constructed in the same exact location as the original deck. If such evidence cannot be provided, the deck will need to be removed. Additional Comments: If it can be determined that the original deck was legally constructed as discussed in Item #1 above, the following comments will also apply to the proposed deck replacement. However, it is advised that you wait to address the following comments until you determine if the deck could be legally replaced within the minimum required 15-foot rear setback as discussed in Item #1 above so that you do not incur any unnecessary expenses if it is found that the original deck was illegally constructed and the replacement deck must be removed: a. Site Plan: Refer to Handout #1357 (enclosed) for minimum site plan requirements and revise your site plan as necessary to include the minimum site plan information. b. Lot Coverage: Lot coverage is defined as the total ground coverage of all buildings or structures on a site measured from the outside of external walls or supporting members or from a point two and one-half feet in from the outside edge of a cantilevered roof, whichever covers the greatest area. The maximum allowed lot coverage for the RS-6 zone is 30 percent of the net lot area. Please provide lot coverage calculations on your site plan, including the footprint of the existing residence, proposed deck, and any other structures on the site (i.e. shed, garage, gazebo, decks, covered patios, etc.). The proposed lot coverage will need to be calculated as a percentage of the net area of proposed Lot 2 of your associated subdivision (PLN20080006). c. Hei ht: Indicate the height of the proposed replacement deck on an elevation view. d. Landslide Hazard Area: Due to the proposed deck's location within the minimum required 50-foot buffer from the Landslide Hazard Area, a geotechnical report addressing the applicable critical areas requirements of ECDC 23.40 and 23.80 will be required. All submittals should be made to a Development Services Permit Coordinator, Monday through Friday, between 8:00 am and 4:30 pm.
