Dear Fred,
I have again reviewed the above building permit application for the Planning Division; thank you
for the June 6 resubmittal. Before I can sign off on the permit, however, the following
information needs to be clarified in a written response:
1. Hot tub: A hot tub is shown of Sheet A2.2. Please show that on the site plan (A1.1) as
well be either redlining or submitting updated plans. If the hot tub is proposed rather
than existing, the structure must comply with the required rear setback (25') unless it
is less than 36" in height in which case it may be located within the required setback
as an 'improvement of a minor character less than three feet in height' per the
definition of "structure" in ECDC 21.90.150:
Structure means a combination of materials constructed and erected
permanently on the ground or attached to something having a permanent
location on the ground. Not included are residential fences less than six feet in
height, retaining walls, rockeries, and similar improvements of a minor
character less than three feet in height.

Please submit three copies of your updated site plan (one being reduced size of 11 x 17 or
smaller) and two sets of any updated sheets of the building plans. Please make all
submittals to a Permit Coordinator, Monday through Friday, 8:00 am to 4:30 pm. If you
