The standards and criteria governing the isguance of Conditional Use Permits are as follows: A. That the use will not endanger the public health, morals and general welfare if located where proposed and developed, and recognizes and compensates for variations and degree of technological processes and equipment as related to the factors of noise, smoke, dust, fumes, vibration, odors and hazard or public need; and B. That the use meets all required conditions and specifications set including the general forth in the zone where it proposes to in Chapter 12.14 locate; of this Code; and 1"I provisions set forth C. CU-35-80 NI14A GRADER - Conditional Use Permit for filling of more Ma�n �cubic yards at 1208-18 Puget Drive. Site review by Engineering staff disclosed an apparently re- cent fill of larger extent than that which is shown on ap- plicant's drawings. An existing large spring or stream crosses the fillbetweenlines shown as Sections A -A and A-B on applicant's plan. This area to the South is very wet and boggy and Engineering considers that inade- quate provisions have been proposed for intercepting the many streams and for carrying the water through the fill in a manner that would prevent saturation of the fill. This is further evident by the wet and loose character of the fill which has already been placed. There is al- so evidence of fill placed over boggy areas as well as over stumps, debris and other organic material which may aggravate the stability of the fill. Such debris should be removed before fill is placed. Drainage lines shown on applicant's plan do not appear to reflect conditions as observed on the site. Staff hydraulics engineers' comments are as follows: "y Elevations: Contour line labeled "0" becomes a line armed "; fill should remain above low point elevation on 12th Avenue North. Land Stabil_i�t_yY Any slopes over 30 percent in this area �w are c.assi'tied as presenting severe landslide hazards. Slopes shown on applicant's plans indicate up to 80 per- cent slopes in the fill area. r�? Erosion Control: To prevent sediment from entering; the streams wit in the property, exposed soil surfaces should be provided with erosion control measures. Drainage out lets require proper design of measures to prevent scouring. Drainage: Properly designed details are required to nre- ? vent sediment buildup in cross -drain pipes. Such details should be shown at all inflow locations, around pipe per- forations, and at pipe ends. Drain lines extending through the fill should be tight lines to prevent saturation of the fill. Proper measures should be designed to prevent street p runoff from entering the site. On slopes over 15 percent, drain lines should be tight -lined to the valley floor and 51 proper anchorage of lines should be designed and specified 'r on the drawings. Chairman Roy welcomed the audience and explained the functions of the Board, the procedure of the hearings, and the method of appealing decisions of the Board. Mr. Bowman reviewed the variance criteria. This would not amount to a rezone. The conditions not generally applicable to other properties in the same district were that the subject property is a corner lot and must meet front yard setbacks from both Hindley Lane and 9th Ave. N. Strict enforcement of the zoning code would restrict the design and location for a garage on this property. The special conditions were not the result of actions of the applicant. The practical difficulty was that there really was no other place to construct a garage unless it was to be off 9th Ave. which is a very busy street. The granting of the variance would not be detrimental to the health and safety of property owners in the vicinity. Mr. Bowman considered this to be a minimum variance to make possible reasonable use of the land, and he felt granting of the variance generally would be in harmony and compatible with the zoning code. The applicant intended removing an existing nonconforming one -car garage and constructing a larger garage, meeting all the setbacks except for the requested variance. Mr. Bowman recommended approval. The hearing was opened to the public. Dick Geigte, P.O. Box 2309, Lynnwood, representing the applicants, said the existing garage is too close to 9th Ave, and too small, and the applicants wish to construct a two -car garage accessing from Hindley Lane. Lou Oskowski, 710 Hindley Lane, asked how far back from Hindley Lane the new garage would be and he was told it would be 25'. He said there is a traffic jam at Hindley and 9th every weekend and if the garage were too close to the street there would be cars parked there and a sight obstruction created. (At this time Mrs. Derleth arrived.) Mr. Geigte was asked how large the garage would be and he said it would be 18' wide, not actually a two -car garage but a large one -car garage. The public portion of the hearing was closed.
