Thank you for coming in on December 5 to discuss your project. Your submittal of the final
geotechnical special inspection letter dated August 13, 2002 resolved my concern about the block
wall on the east. I was subsequently able to find a copy of that letter in another portion of our files
for that site but did not find approved plan documents for the wall, steps or path — they were likely
changes in the field that were not reviewed through the usual building permit revision process.
Regardless, because the City received the final inspection report noting the wall, that portion of my
November 30, 2012 comment letter has been addressed.
With regard to the western 15-foot native non -disturbance area, I discussed with my manager our
conversation and in looking at the short plat requirements and the language of the CCRs, a different
way forward was discussed. First, the gardens and planting beds in the southern portion of the
native non -disturbance area can remain provided your geotech submits a letter addressing the
features relative to the code requirements in ECDC 23.80.060 and 070. If the structures and beds
do not negatively impact slope stability, they can remain.
At the same time, the CCRs clearly indicate that lawn grass is prohibited in the 15-foot native non -
disturbance area. So, to bring that space into compliance you will need to enhance the area with
native ground covers, shrubs, and the like as we had discussed on December 5. Those plantings can
be carefully interspersed with the lawn grass so that the natives will eventually take over the space
without removing the lawn and disturbing the top of the slope any more than necessary. Please
revise the landscape plan submitted on October 31 to show the types and locations of the plantings
selected for the lawn area. Also on that plan, show the planting beds and other features discussed
by your geotech at the southern end of the non -disturbance area so those are on record as well.
