RETAINING WALL & FENCE AT 509 9TH AVE. N
Dear Eric,
I have reviewed the above building permit application for the Planning Division. Before I can
sign off on the permit, however, the following information needs to be clarified in a written
response and on plans with changes called out:
1. What is proposed?: Your building permit application states a retaining wall/6' cyclone
fence is proposed. Yet, the October 22 site plan and geotech addendum dated
October 17, 2013 describe a wall/fence near the southern property line in addition to
a 4' retaining wall with planters in the middle of the property, and, finally, an in -
ground hot tub. Please submit a narrative describing the complete scope of the
proposal including the height of the wall/fence, whether the southern wall is a
retaining wall or just a portion of a fence, and location of the hot tub equipment.
2. Retaining wall/fence: According to ECDC 17.30.000.D: "When a retaining wall three
feet in height or greater is contiguous to and below a proposed fence, the proposed
fence may be constructed for the purposes of safety not greater than four feet above
the top of the retaining wall or the finished grade, whichever is less, without the
necessity for a variance." If the south wall is not a retaining wall and just the lower
portion of a fence, that wall/fence can only be a maximum of 6' tall. If it is a retaining
wall and fence on top, submit an elevation view showing the entire length of the
proposed wall/fence within the southern setback area to verify compliance with this
requirement.
3. Hot tub equipment: No hot tub equipment is shown on the site plan — update the site
plan accordingly. The Building Division will have additional comments regarding the
hot tub regarding safety, filling and draining, etc.

Please submit three copies of your updated site plan (one being reduced size of 11 x 17 or
smaller) and two sets of any updated sheets of the building plans. Please make all
submittals to a Permit Coordinator, Monday through Friday, 8:00 am to 4:30 pm. If you
