1.
Legal access, at present, to the subject property is.a 2'0'- : ,
foot wideownershippanhandle. In 1969, a non-exclusive

ingress/egress easement was granted to the property to the,a
south over that 20' strip. This easement was to be the only.">
means of access to the neighboring property on which `was. +z,`
developed a 15-unit condominium complex. The condominium`
property is located on the corner of Puget Drive and 9th Ave.
W., however, the steep grade limited access to 9th Ave. N.
Per Section 18.80.010 of the Edmonds Zoning & SubdivisiontY
Code, any access serving 15+ units can only be approved by
the Hearing Examiner.

The property differs from other properties in the same
vicinity in that its accessis limited to a 20 foot wide
panhandle and cannot be served by any other means.
3..
This variance request, if granted, will not be detrimental
to the Public or damaging to other properties or improvements
in the vicinity. It will allow an undeveloped parcel of land
approximately .8 ac. in size to be developed and improved. The
site is surrounded by residential development on all sides.
4.
If this variance request is not granted, the site will not be
able to be developed. Even if the variance is granted and a
concurrent short plat approved, the housing density on site.
will still be lower than the zoning regulations could allow.
ANy hardship will not have been caused by the property owners
own action.
5.
Without the variance request granted, the property cannot
be developed. If approved and contingent upon short plat
approval (S-22-81), the site can be divided into two 18,000 r
S.F. lots that will nicely conform to the residential atmos-
.hereof its surroundings. It is an extreme hardship on the
property owner if the variance request is not approved.

After due consideration of the evidence presented by the
Applicants; evidence elicited at the public hearing; and as a
result of the personal inspectionof the subject property and the
surrounding area by the Hearing Examiner, the following findings•of
fact and conclusions constitute the basis of the decision of the
Hearing Examiner.
FINDINGS OF, FACT
1. The Applicants have requested approval of a.variance from the
required street standards of the City of Edmonds, WA, in order
to allow two additional residential lots to access off of a 20
foot easement road that is serving 15 units at property
located at 1412 9th Ave. N, Edmonds, WA, and more particularly
described as set forth above.
2. The Applicants in submitting their requests for a variance has
submitted a plot plan showing the location of the requested
variance to allow access to -the residential lots. A`copy of
the plot plan is attached hereto and by this reference is
hereby incorporated as part of these findings.
3. As shown on the attached plot plan, the Applicants own lots l
and 2 and also own the panhandle strip of land, that fronts 9th
Ave. This panhandle strip of land provides access to the
Sunstone Condominiums, which are a condominium group of.
housing that consists of 15 units. The specific request for
the variance is to provide access to lots 1 and 2 and to the
developement that is expected to be made on these lots.
4. The City of Edmonds has established street standards for street
construction within the City. These standards are set forth
in section 18.80.010 of the Community Development `Code.
5. As set forth in section 18.80.010, any development which has a
potential number of lots or units exceeding 16 has street
standards that are dependent upon the design. It is the
Planning Department of the City of Edmonds' interpretation
that any standards existing for this type of development must'
meet at least the minimum pavement widths of other
developments. In these other developments the standards are
at least 22 feet of pavement width.

6. The strip of land currently serving the access to the Sunstone
Condominiums and the proposed access to lots 1 and 2 is a
strip of land of 20 feet in width. This strip of land will
provide access to at least 17 lots or units.
7. It is the interpretation of section 18.80.010 by the Planning
Department of the City of Edmonds, that in order to provide
access to lots 1 and 2 through the aforementioned pandhandle
section of the subject property, a variance is required from
the street standards of section 18.80.010.

the City of. Edmonds to be granted it must be shown that; there

is conformance with section 20.85.020 of the Edmonds Community

Development Code. In particular, the Applicants must show
that special circumstances do exixt for the granting of the
variance; the granting of the variance will not be a special
privilege accorded to the Applicants; the variance would be
consistent with the Comprehensive Plan of the City of Edmonds
and the zoning ordinance in the zoning district in which the
.
subject property is located; and, that the variance would not
be detrimental to public health, safety or welfare or be
injurious to property or improvements in the area of the same
zone.
10.
The subject property is irregularly shaped. Because of this
irregular shape, the only access to the property is off of the
aforementioned 20 foot wide pandhandle that provides access
from 9th Ave. North to the subject property.
11.
In 1969 was an easement was granted by the Applicants to the
owners of the Sunstone Condominium which provided the access
to the condominiums. As a result it is now imperative on the
Applicant to secure a variance in order to have access to his

property.:;

It appears that special circumstances do exist in that the
pandhandle section is the only access to the property and 'the;'
-
property cannot be devloped without this access.
13.
The granting of the variance would not result in the granting'
of special privileges.`
14.
The granting of the variance would not be in conflict with
the Edmonds Comprehensive Policy Plan.

The granting of the variance is consistent with the zoning
ordinance in an RS- 12 zone. The variance would not be

to the property or improvements in the area, if certain
conditions are met.

The variance appears to be the minimum needed for the
reasonble use of the property. The Planning Staff of the City

of Edmonds has recommended approval of the requested variance:.

Testimony was received from a property owner on the south side

of . the panhandle section objecting to the granting of the
variance. The basis of the objection of the property owner `F
.was that it would: a) increase traffic on the road in such, a,
manner as to become a danger to all concerned; b) effect his

property in that it would encourage peoples to utilize his
property as access to the condominiums, and; c) it would

create drainage problems because the area would have more l>:`
development.

The Applicants testified that all drainage would be handled on
sites of lots 1 and 2. -

The Applicants testified that he would be willing to

participate in some type of barrier along the northeast corner
of the neighboring property in order to insure that the
property was not used as access for the condominiums or his

The owner of the Sunstone Condominium also expressed interest
in participating in the cost and construction of any barrier `

CONCLUSIONS
P
1.
The application is for the approval of a request for a
variance from the required street standards of the City of
Edmonds in order to allow two additional residential lots
access off of a twenty foot easement road currently serving 15 ,

units and intended to serve more than 16 units of lots in the
near future. The subject property is located at 1412 9th Ave.
N., Edmonds, WA, and is more particularly described and set. �.
forth above.

Section 18.80.010 of the City of Edmonds Community Development

Code requires that all development that has a potential number

of lots or units exceeding 16 must have street standards that.
are dependant upon the design. The Planning Department has
interpreted this to mean that the street standards must meet
at least minimum standards of developments that have a fewer
number of lots or units.

The access road to the Applicants' property is a_ 20 foot wide
panhandle strip that currently serves 15 condominium units and
will serve more units or lots in the future. Thus, it is
incumbent that the Applicant either increase the size of the
panhandle strip or obtain a variance in order to use the
panhandle strip as access. -
