For this project we propose a total excavation of 1,730 cubic yards. The existing grade on the site rises approximately ten feet (10') from Third Avenue to the alley at the rear of the property. We feel that the best solution for this site is to excavate into the existing grade for an open parking garage, under the proposed structure. Through a process of exploring several different design schemes, we found this scheme to be most beneficial by: 1. Not imposing more traffic on the existing alley at the rear of the property; 2. Provide screening of the parking area by recessing it into the existing grade and landscaping the perimeter, therefore; 3. Providing the required parking for the proposed office building without creating an objectionable and unsightly parking area. We have designed this project to Fit with our perceived understanding of the nature and character of downtown Edmonds, and hope that you will find it satisfactory for your purposes as well. Description of the Subject Property and Surrounding Area The subject property is located on the east side of 3rd Ave. S. The lot contains approximately 8,760 sq. ft. of land area. There is an existing older single family house located on the site. The lot slopes moderately from the east to west at approximately a 7% grade. The Applicant intends to excavate approximately 1,730 cubic yards of earth to allow development of the site into a professional office building. The excavated area will be used for off-street parking. Surrounding development is primarily commercial. There are some single family and mutiple family dwelling units located to the west, across 3rd Ave. S. B. Zoning Ordinance The subject property, as well as the surrounding area, is zoned BC. The requested conditional use permit does not appear to conflict with the purposes of the Zoning Ordinance or the BC zone. D. Comprehensive Plan The subject property and surrounding area is designated as a Commercial/Business. The proposed conditional use permit does not appear to conflict with the purposes of the Comprehensive Plan. The grading will allow the required parking to be placed under the proposed building. E. Not Detrimental The proposed use should not be significantly detrimental to the public nor to nearby private property or improvements. A mitigated declaration of nonsignificance has been issued on this project. F. Transferability The permit should be transferable. V. STAFF RECOMMENDATION: Staff recommends approval of CU-46-86, subject to the following conditions: 1. All excavation and grading shall comply with Chapter 70 of the Uniform Building Code. 2. A hearing on the request was held before the Hearing Examiner of the City of Edmonds, Washington, on November 6, 1986. The application is.for the approval of a conditional use permit for grading approximately 1,730 cubic yards of material at 149 - Third Avenue South, Edmonds, Washington. (Staff report.) 2. Section 18.40.030 of the Edmonds Community Development Code (ECDC) sets forth that no person shall perform any grading involving more than 500 cubic yards of material on any lot, or contiguous lots, without first obtaining a conditional use permit. Because the application involves more than 500 cubic yards of material the Applicant is seeking a conditional use permit. (ECDC.) 3. In order for a conditional use permit to be granted within the City of Edmonds, the criteria as set forth in Section 20.05.010 ECDC must be satisfied. These criteria include: A. The proposed use must be consistent with the comprehen- sive Plan of the City of Edmonds; B. The proposed use in its location must be consistent with the purposes of the zoning ordinance in which the property is located; and, C. The proposed use must not be significantly detrimental to the public health, safety or welfare, nor injurious to nearby private properties or improvements. (ECDC.) 4. The subject property is located on the east side of Third Avenue South in Edmonds. it is a lot consisting of 8,760 square feet of land area. Located on the lot is an existing older single-family house. It is the intent of the Appli- cant to develop the site with a professional office building. In developing the site, excavation will occur. (Bowman testimony.) 5. The lot slopes moderately east to west at approximately a seven percent grade. 'In order to excavate the lot, it is necessary for the Applicant to remove 1,730 cubic yards of earth. The excavated area will be used for off-street parking. (Staff report.) 6. The Comprehensive Plan of the City of Edmonds designates the subject property as Commercial/Business. (Staff report.) 7. The property is zoned Commercial Business (BC). (Staff report.) 8. The surrounding development in the area is primarily commercial. On October 28, 1986, the Edmonds Planning Department issued al mitigated declaration of nonsignificance (DNS). The mitigated DNS was subject to eight conditions which the Planning Department has adopted as conditions in support of their recommendation of approval. (Staff report.) 10. The Applicant has submitted that the method in dealing with the existing grade on the site will be to excavate the site f'or an open parking garage that will be located under the proposed structure. This proposal will be beneficial because it will not impose additional traffic on the existing alley at the rear of the property; will provide screening of the parking area by recessing it into the existing grade and landscaping the perimeters; and, providing for the required parking for the proposed office building without creating objectionable or unsightly parking areas. (Exhibit 2.) 11. No adverse testimony was received at the hearing. CONCLUSIONS 1. The application is for the approval of a conditional use permit for grading approximately 1,730 cubic yards of earth material on property located at 149 Third Avenue South, Edmonds, Washington. 2. In order for a conditional use permit to be granted within the City of Edmonds the criteria as set forth in Section 20.05.010 ECDC must be satisfied. The proposal, with conditions, satisfies these criteria. 3. The proposed excavation is consistent with the purposes of the zoning ordinances and the BC zone of the City of Edmonds. 4. the proposed conditional use permit for the grading on the Subject property does not conflict with the Comprehensive Plan of the City of Edmonds. It will allow the site to be developed in a manner that will provide parking under the proposed building. With such a plan,landscaping and a more aesthetic development will occur. 5. The proposed use will not be detrimental to the nearby private properties or improvements. 6. IThe conditional use permit should be transferable. DECISION Based upon the preceding Findings of Fact and Conclusions; the testimony and evidence submitted at the public hearing; and, -3- HEARING EXAMINER RE: CU-46-86 upon the impressions of the Hearing Examiner at a site view, it is hereby ordered that the requested conditional use permit for grading approximately 1,730 cubic yards of earth on property located at 149 Third Avenue South, Edmonds, Washington, is granted subject to the following conditions: 1. All excavation and grading shall comply with Chapter 70 of the Uniform Building Code. 2. The Applicant shall submit an erosion control plan for review and approval by the City Engineer prior to the issuance of grading permit. 3. The Applicant shall obtain a grading permit from the Building Department and comply with all conditions of permit approval. 4. The Applicant shall submit a truck route plan to the City Engineer for approval prior to removal of excavated material. 5. Should the City of Edmonds be required to clean any streets as a result of } the activity of the Applicant, the Applicant shall be responsible for reimbursing the City for said costs. 6. All grading work shall be done during normal working hours of the City of Edmonds. The normal working hours are 8 a.m. to 5 p.m., Monday through Friday. No activity shall occur on weekends. 7. The Applicant shall be responsible for providing verifica- tion of the total amount of excavated material prior to finalizing the grading permit and obtaining a building permit for the proposed office building on the site. Should the final excavated material exceed 1,730 cubic yards of earth, the Applicant must apply for an amendment to this permit. 8. The Applicant shall notify the Fire Department prior to any commencing of grading activity. 9. The conditional use permit is transferable.
