Dear Mr. Garcia,
I have reviewed the above building permit application for the Planning Division. Before I can sign
off on the permit, however, the following information needs to be clarified in a written response
and through submittal of updated plans:
Fence: While the proposed fence replacement along a portion of the east property line
does not require a permit, the fence must meet the requirements of ECDC 17.30. The
fence may be a maximum of 6' in height unless a trellis is envisioned that meets the
standards of 17.30.035.
2. Proposed deck: The proposed deck does not meet setback requirements for the RS -12
zone. A minimum 25' setback must be maintained from the south property line. An
exception to that for porches and decks is found in ECDC 16.20.040.0 which'states:
"Uncovered and unenclosed porches, steps, patios, and decks may project into a required
setback not more than one-third of the required setback, or four feet, whichever is less;
provided, that they are no more than 30 inches above ground level at any point." The site
plan shows the proposed deck encroaching 8' 8" into the required setback. Please revise
the site plan to show compliance.

Please submit three copies of your updated site plan and two sets of any updated sheets of the
building plans. Please make all submittals to a Permit Coordinator, Monday through Friday,
8:00 am to 4:30 pm (closed Wednesdays for permit intake). If you have any questions, please
