Dear Feng Lin,
It has come to the City's attention that several features were built during the construction of
your new single family house that were not on the approved plans. Moreover, these features
do not appear to meet code requirements or available exceptions. Specifically:
1. South deck: The approved plans show the new house being built up to the required
10' side property line setback on the south and a small stoop projecting 3.33' into the
setback. Instead, a wood deck was constructed that takes up most or all of the
required setback area. This does not meet the code exception in ECDC 16.20.040.C.
The uncovered deck may only encroach up to 3.33' into the required setback and only
if the deck is less than 30" above ground level at any point. To resolve this issue, the
deck must be removed and the stoop installed per the approved plan or a plan
revision must be submitted showing a wood deck that is compliant with the identified
setback exception.
2. Retaining wall and fence: A 60' +/- length of retaining wall and fence were
constructed along your south property line extending east from near the 74th Ave.
right-of-way. This feature was not shown on the approved plans. More importantly, it
appears that the wall/fence does not meet code requirements for height as found in
ECDC 17.30. By definition, structures such as retaining walls may only be 3' in height
where located within a required setback area. Further, ECDC 17.30.000.D indicates
that when a retaining wall 3' in height is contiguous to and below a fence, the fence
may be only a maximum of 4' above the top of the wall. To resolve this issue, submit
a plan revision showing a retaining wall and fence of complying height. If approved,
the current wall/fence will have to be rebuilt to plan.
3. Retaining wall near southeast corner of house: A 10' block wall was built in the south
side setback area extending from the house to the south property line. This feature
was not shown on the approved plans. As noted above, retaining walls cannot be
more than 3' in height where located within a required setback area. To resolve this
issue, submit a plan revision showing a retaining wall of complying height. If
approved, the current wall will have to be rebuilt to plan.
