As you may recall, we spoke last winter regarding the
Meadowdale slide area and the resulting danger to the
houseoowned, by my client.Mrs. W. A. McGraw.at 16429 - 75th
Place West in Edmonds.
I have spoken recently with Mr. and Mrs. McGraw, and they
advise me that the city, pursuant to the easement and hold
harmless agreement they executed last December, has installed
a curtain drain at the base of the hillside behind their
house. I understand, however, that the curtain drain does
not extend all the way beyond the end of the house. The
McGraws have consulted with Mr. Bob Aklin, who I believe
is familiar to you. Mr. Aklin has a great deal of experience
in the installation of drainage systems, and it is his opinion
that the drain should be extended to the northeast property
line of Mrs. McGraw's house. Mr. Aklin has submitted a bid
of $1500 to do the work, a copy of which I enclose for your
information. Mr. Aklin is of the view, I understand, that the
drain as it stands does not reduce the danger to the McGraws'
house to the extent it would if the drain were extended.
Mr. and Mrs. McGraw would be pleased if the city would under-
take to extend the curtain drain as Mr. Aklin has proposed.
Please look the material over and give me a call at your
earliest convenience. Mr. Aklin is available to discuss the
matter at 542-5317.

HISTORY/SUMMARY STATEMENT:
The November, 1984 slides below the Solie residence at 16431 - 74th
Ave. W. revealed additional sources of subsurface water. This water
is now making its way to the street and could cause additional damage
to our storm drainage structures and the street.
This is the type of situation that we anticipated and budgeted
$70,000 for 1985.
*$70,000 was budgeted for extensions of the Meadowdale drainage
system for 1985.

debris upon the property of the Grantor, and,

WHEREAS, the City of Edmonds finds that removal of all
or part of said earth and mud is in the public interest in order

public and public streets and other improvements, now,
therefore,
IN CONSIDERATION OF the agreement of the City of
Edmonds, Washington, an optional code municipal corporation
(hereinafter "City")•to remove mud and debris deposited on the
Grantor's property on or about the day of
1984, the Grantors herein Dorothy M. McGraw
do grant to the City a temporary
construction easement for the removal of said mud and debris and
a hold harmless agreement as hereinafter provided:
1. Temporary Construction Easement. The Grantors hereby
grant to the City of Edmonds, its officers, employees, contrac-
tors and assigns, a temporary construction easement on and over

2. Hold Harmless Agreement. The Grantors promise and agree
to indemnify and hold harmless the City, its officers,
employees, agents and assigns, from any and all liability of
whatever kind or nature arising from or out of damage to the

in accordance with this easement and agreement, Provided, however,
that nothing herein shall prevent the Grantor frau bringing a claim
or suit against the City's contractor, engaged for the purpose of
such removal, if any damage or injury, to persons or property,
should arise frau or be occasioned by the sole negligence of the con-
tractor and where such claim is compensable frau any contract of
insurance held by. the contractor which is for the benefit of third
parties. It is the intention of the parties hereto to save and

As a result of your letter dated December 18, 1981, we have
gone out to your property for an on-site inspection. I am of
the .opinion that a relatively small amount of earthwork will
provide positive drainage and thus remove your swamp and alleviate
your water problems. This type of work is generally handled during
the site preparation prior to construction and -should not signifi-
cantly increase development costs.
The assessment on your property was based on the benefit that
would be realized if sewers were available for your property.
Macaulay and Associates appraised each site on an individual basis
and if you have specific questions regarding your assessment; we
can relay the questions to the appraiser and the City Attorney
for their response.
If you have any additional questions regarding this matter,

A site inspection of the property has revealed a lot developed with'a single family dwelling and
with rolling hills and a very steep bank sloping up to the east. Some of the rolling hills have
steep sections, and the steep bank appears to slope upward at a rate greater than 40%.
Based on the above findings, it is determined that there is potentially a steep slope critical area on
or adjacent to the site. A Critical Areas Study is required to delineate the boundaries of this
potential critical areas, the buffers and setbacks. For the steep slopes, a licensed surveyor must
create a topographic map of the site which indicates all areas which slope 40% or more and have
a vertical gain of 20 feet or more within the 40% slopes. The map must also show the location of
the steep slope buffers and setbacks. The surveyor must also create legal descriptions for the
critical areas and the buffers.
If the property owner wishes to apply for a specific development permit which they feel would
not impact the Critical Areas located on the site, they may submit their proposal to the Planning
Department for review. If the Planning Department finds that the proposed development permit
will not adversely impact a Critical Areas or its buffers, a conditional waiver may be issued on a
project by project basis. ____7
