Conflicting geotechnical reports/setbacks: The recommended setbacks from top of slope do not appear to be consistent between the geotech's June 30 report and the July 26 report. A 15' setback from the top of slope was recommended in the June 30 report. This line is shown on the July 28 Site Plan. However, some lesser distance from the top of slope appears to be identified in the July 26 report on page 10: "The setbacks are adequate." The report does not say what that distance is. If the setback from top of slope is 15' per the June 30 report, the house will have to be redesigned to comply — no part of the house, dry stack wall, and the like can be located within the setback. If the setback was reduced as part of the foundation/pile change, identify what that setback is now supposed to be and show it on the Site Plan. If I can't determine how the geotech is addressing the requirements of ECDC 23.80 in the next submittal, I will require peer review pursuant to ECDC 23.40.090.6: Independent Review of Critical Areas Reports. Critical areas studies and reports on geologically hazardous areas and those developed by an applicant representative or consultant not as part of a three -party contract may, at the discretion of the director, be subject to independent review. This independent review shall be performed by a qualified technical consultant selected by the city with all costs borne by the applicant. The purpose of such independent review is to provide the city with objective technical assistance in evaluating the accuracy of submitted reports and/or the effects on critical areas which may be caused by a development proposal and to facilitate the decision - making process. The director may also have technical assistance provided by appropriate resource agency staff if such assistance is available in a timely manner. 2. New critical area notice to title needed: The Snohomish County Auditor would not accept the previously emailed copy of the critical area notice to title because it had black lines on it. Please submit a clean original signed copy of the document for recording. 3. Driveway wall: The western extent of the driveway wall would be taller than 3' above original grade within the required setback.
