FINDINGS OF FACT 1. The Applicant has requested a Conditional Use Permit to allow her to operate a home day care facility out of her residence at 17509 71st Ave. W., Edmonds. She rents the home from William Becker and has occupied the residence since November of 1985. 2. The subject property is zoned RS-8, as established by the Edmonds Community Development Code (ECDC). 3. The Comprehensive Policy Plan Map designates the subject property as Low Density Residential. Staff De cision i_-12-87 Page 2 Kellogg 4. The subject property is developed with a single fam ily residence. it is located on the southeast corner of 71st Ave. W. and 175th Pl. W. 5. The following are the review criteria for home day care facilities, as outline d in Chapter 20.19 of the ECDC: A. State The Applicant must obtain and comply with —�—Ilstate licensing requirements. B. The Applicant testified that she has obtained a state license for a home day care facility to care for up to six children. 8. The Applicant that she intends to operate the day care from early morning to late afternoon (6:00 a.m. to 6:00 P.M.) 9. The outdoor play area is a fenced yard in front of the residence, bedroom, living along 71st Ave. W. Indoor play areas will be a 9 and 6 room and kitchen. outdoor play times will be between a.m. p.m. 10. Dorothy Looney testified that she had no particular problems with the application, other than her neighbors had expressed concerns about noise. rnNri INMN'_� 1. The application is for the ap I proval of a conditional use permit for a home day care facility at 17509 71st Ave. W., Edmonds. 2. The subject property is zoned RS-8 and is designated as Low Density Residential on the Comprehensive policy Plan Map. 3. The Applicant has obtained obtained her state license to care for six full-time children. Staff Decision L-12-87 Page- 3 Kellogg 4. The proposed use appears to be consistent with the Comprehensive Plan. 5. Home day care is an allowed use in the RS-8 zone with the grant of a conditional use permit. 6. The proposed day care, as conditioned, does not appear to pose any significant impact to the public or nearby private property or improvement. 7. The proposed day care complies with the review criteria of Chapter 20.19 of the ECDC, as outlined in the Findings of Fact. The only criteria that the proposal conflicts with is the requirement that no play area be allowed in the street setback. Since the property is a corner lot, it does not have a typical rear yard setback. The play area proposed is fenced and is away from the paved road surface. DECISION Using the above findings and conclusions as the basis for the decision of the Assistant City Planner, the application for a Conditional Use Permit for a home day care at 17509 71st Ave. W. is hereby granted, subject to the following conditions: 1. The Applicant is to comply with all State licensing requirements for a home day care facility. 2. The total number of children may not exceed six. 3. The hours operation are to be no earlier than 6:00 a.m. or later than 6:00 p.m. 4. outside play times shall be be between 9:00 a.m. and 6:00 p.m. 5. The Applicant must obtain a Business License from the City Clerk. 6. Approval of this permit shall be subject to an inspection by the City Fire Marshal to insure that a smoke detector and fire extinguisher have been installed. This Conditional Use Permit is granted subject to the authority granted the Planning Staff as outlined in Chapter 20 95.060 of the ECDC.
