WHEREAS, Ilialter Ce Eriksen hereinafter
referred to as "Owner" " is the owner of the certain real property
located in Edmonds, Snohomish County, Washi ngton, and more fully
described on Exhibit A attached hereto and incorporated herein as
though fully set forth in full, and
WHEREAS, owner presently contemplates constructing a
building*on said property which said building will face on 228th
Street S.W., a presently.unopen street and,
WHEREAS, owner has applied for a variance from the front
yard setback requirements of the Edmonds Zoning Code for said building
under application No. , V-5-77 — and,
WHEREAS, the Edmonds Board of Adjustment, at a regular
public meeting on February 16, 1977,.granted owner a variance pursuant
to said application No. V-5-77 under certain conditions and,
WHEREAS, one of said conditions was that should the City
ever decide to construct a through street on 228th from Highway 99
to 76th.Street S.W.,,. owner or his successors Would move said building
to conform with the setback requirements of the Edmonds Zoning Code,
NOW, THEREFORE, in consideration of mutual benefits owner
.covenants for himself and his successors, heirs and assigns with the
City -of Edmonds, Washington, hereafter referred. to as Grantee as
follows:
(1) That should Grantee ever improve 228th Street.S.W.,
between Highway 99 and 76th Street S.W., in order to accomodate through
traffic between Highway 99 and 76th Street S.W., owner shall move the
above referenced building in order to conform with- the front yard

(2) Compliance with the terms and conditions of this
covenant shall be entirely.at the owner's expense.
(3) In the event owner fails or refuses to comply with
any of the terms and conditions of this covenant, then.grantee is
required to seek legal iL'd�*V*ice or to commence litigation to enforce
the terms of this covenant, owner agrees to pay all costs, expenses
and fees of grantee, including but not limited to reasonable attorneys
fees.
(4) This covenant and all the terms. thereof shall be
binding -upon the present and future owners of said real estate and
the owner's successors in interest and/or assigns.
