Silt and residue was found in the storm/creek system downstream of the Jurich property where your construction company, Designworks Construction, is working under the building permit 2009-0505. The erosion control measures in place are not sufficient to keep all silt runoff on your site. This storm/creek system leads to Northstream Creek and discharges directly into Puget Sound. The system is intended for storm runoff only and the water receives no treatment downstream, which means that fish and wildlife habitat are impacted by any pollutant discharges. Construction runoff can be significantly detrimental to this habitat. The discharge of silt runoff into the City's stormwater collection system due to construction activities constitutes a violation of Edmonds City Code 7.200.070 A 2 and is subject to enforcement actions. Payment of fines to cover administrative and remediation costs associated with this violation is authorized in accordance with Edmonds City Code 7.200.150. In accordance with these regulations you are hereby directed to, 1 ) Abatement of illegal discharge to stream within 24 hours of this notice. 2) Pay fines of $100 per day and all costs associated with the enforcement of each violation, including but not limited to administration expenses and remediation costs associated with this violation. 3) Within 24 hours of this notice necessary erosion control and sedimentation shall be in place and an erosion control plan with outline of steps taken must be submitted to the Engineering Division for review. If you should fail to meet the deadline given for implementation of effective erosion and sediment Control, the Public Works director will send out a city crew or a designated contractor to perform the necessary work, and the expense thereof shall be charged to the violator.
