According to City records On Dwelling Unit (ADU) 10cat lication for an ADU with the planning Department in order to July 14, 2000 you made app legitimize your illegal unit. This action was due to the City's interim ordinance that allows existing illegal ADU's to become legitimate by applying for permit approval by October 15, 2000. After this date non -conforming existing illegal ADU's can not be 'grandfathered'. You also submitted an application for the required compliance building including field verification of all life -safety permit and I explained the permit requirements ived a building permit, items in the second dwelling. You then stated you had already rece however as you were previously notified by letter dated 8/11/00, no such permit or approval exists in City records. The building compliance permit was issued on 8/10/00 and you scheduled Mike Snook, ection on 8/29/00. During that site visit You alleged that ilding Inspector for insp, City Bu ved the bedroom men City inspectors had visited the site and had already appro de two wo window size which by Mr. Snook's measurement is substantially less than Do egress minimum. Taking you at your word Mr. Snook signed off your job card however, upon ed the issue and determined that you had returning to the office he immediately investigat mislead him. My research indicates that Kathleen Taylor and Chaunda Earhart of our Planning Department made a site visit for the ADU application and both insist that they did id they 'approve' the not discuss specific code requirements of egress windows; nor d ed indicate a bedroom window size. I must also point out that the plans that you provid window size of 44 inches by 68 inches (the field measurement is 15 inches by 43 inches) y incorrect. Also, the City Plans Examiner, Tricia clearly the plans you provided are grossl Bennon provided you with the ADU handout that expressly indicates the minimum egress window size as well as other ADU building code requirements. Be advised, the compliance permit will expire on 02/10/01; prior to this date an emergency egress window complying to UBC Section 310.4 (copy attached) must be installed, inspected and approved. Due to the nature of the violation and since you have indicated to me that the unit is currently vacant you are hereby notified that no person or persons may use or occupy the ADU until the emergency egress window is approved by the City Building Inspector. As previously discussed with you it is not the City's intent to cause you undue hardship however, compliance to the codes is mandatory for the fair and equal treatment of all citizens. Your lot and surrounding neighbors were annexed into the City on 7/26/61. According to County records your home was built in 1955. The County would have a copy of your original house permit and any other permits obtained between 1955 to 7/25/61. Sincethe annexation date you would have obtained all building permits from Edmonds City Hall, and in fact our records show that you obtained a permit on 8/4/70 for a 20x4O Lancer pool, a re-roofpermit was issued on 10/9/95 and a remodeling permit to finish the garage into a recreation room was issued on 11/27/95. Unfortunately, there are no permit records for the conversation of your daylight basement to an Accessory Dwelling Unit. The past discretionary process for this type of approval was cumbersome and it is our experience that many people chose to make such a conversion without first obtaining the proper City building permits and approvals. However, I completely understand your need to have this unit for additional income. In fact that is one reason why the City revised the Accessory Dwelling Unit permit process to make it easier; and also to create a window of opportunity for existing illegal units to apply for permit approval. The Building Department's role in this process is to be assured that minimum life safety codes are met in the accessory unit; that is the purpose of the building compliance permit. This is especially critical in basement applications since emergency escape, natural light and ventilation are commonly not to code. Add a window in the dining room, minimum size 10 square feet; 2. Increase the kitchen window size to a 5' x 5' (minimum) sized window; 3. Remove that portion of wall between the mechanical room and the kitchen bar so that the dining room is open to the living room; 4. Construct a wall to block off the dining area, install a door and label and use the room as storage; 5. Obtain County permit records that show approval for the Accessory Dwelling Unit. If you can find such records the City would refund your permit fees. I can understand your frustration on something that you believe was previously approved but I assure you there are no building permits or planning approvals for the basement accessory dwelling unit. Also, I am sure that we both have the same goal to be assured that any person(s) living in the unit are safe and have the minimum protections and improvements that the code requires. If you need additional time to decide your course of action please inform me in writing. Be sure to include which method you choose for compliance and provide an estimated date as to when the work will be complete. if not, I have established a deadline of compliance of 10/10/00. By this date your must have the work complete and have scheduled an inspection with our Building Inspector, Mike Snook.
