As Administrative Authority for compliance to the Uniform Mechanical Code for the jurisdiction ofEdmonds, it is appropriate that this letter be issued by my office. According to City records, Washington Energy Services applied for and obtained a mechanical permit on your behalf to install two gas fireplace inserts on different floors of your home. The contractor did not indicate the room types that contained these inserts. Enclosed please find Uniform Mechanical Code (UMC) Section 304.5 entitled Prohibited Locations. This section of the UMC specifit ally indicates hazardous locations for the installation of fitel-burning c lated in sleePing rooms - equipment. Note, that gas -fired mechanical equipment is strictly regu Also, please note the exceptions that are permitted by code that allow for such installations. These UMC provisions are written to protect people sleeping since most people are naturally more vulnerable in a sleeping state. If a gas leak or other problem occurs, sickness or death is a potential concern. The City Building Inspector was called for an inspection on January 31P at your residence. Upon inspection he noted that one gas fired fireplace insert was installed in a room that contained a bed. The Inspe correctly identified UMC code provision 304.5, which prohibits ctor i e gas fired mechanical equipment to be installed in a sleeping room without a d r ct vent application. A correction notice was left on site and the contractor followed up with the City in a meeting held on February 8th. At this meeting, the contractor agreed that the referenced code provision should be applied since the room was used as a sleeping room. The City suggested that the contractor contact you to determine the use of the room and apply the appropriate code provision(s) based on how you, as owner, used the room. The contractor called me February 12'h and stated that you insisted that although a bed was set up in the room, the true room use was a rec room not a sleeping room. I followed up with you by phone conversation yesterday and you were adamant with me that the room is a rec room not a sleeping room. You did however admit to me that you have two sons who occasionally sleep over in this room. He told you that the bed in that room is occasionally used for that purpose, and that he and his wife intend intend to continue to use that bed for that purpose. The Jarrs have no intention of changing the use that they make of that room. If that makes the Jarrs' rec room a "sleeping room" for purposes of the Uniform Mechanical Code, so be it.
