renewed prior to expiration for one half fees. If the permit expires without a final

I respectfully disagree with you on your opinion of how I and my staff acted on this permit. We researched the issue

permit..." I resent your insinuation. I did called MT. Salinas and asked that he call you. As I told both you and Mr.
Salinas, he (Salinas) was under no obligation to do so but I thought it to be the neighborly thing to do to discuss the
situation with the wall. Mr. Salinas chose not to call you. The bottom line is Mr. Salinas was issued his permit that

Dear Duane:
My legal council and I are requesting in writin a clarification as to your letter.
1. Is your letter your formal interpretation of issuing your permit? if not I am requesting one from you
or the city attorney.
2. What are my rights to appeal? I have asked your staff three times and nobody had an answer. How
many days do I have to appeal? What are the fees? What are the filing requirements?
I initially felt I was dealing with you in good faith. With over ten personal visits your development services
department and two written complaints I think I made my concerns very clear to you and your staff. I
find that )p-pyr actions in handling this matter have been less than honorable. I completely understand and
ati acti our
acknowledge that you were legally obligated to issue the permit upon s sf on of y required
conditions though I completely disagree with your interpretation in allowing this permit to be issued. I do
appreciate the efforts that your staff went through to review this situation. My issues with you are that
you stated to me in more then one conversation that though not required, you or one of your Staff
members would contact me upon issuing this permit. You did not! Why am I making this an issue? Well
because you eliminated a legal right and a possible final effort to stop Mr. Salinas by court order -
BEFORE HE POURED HIS WALL I did not have a minute, an hour or even a day to review with my
legal council your terms and interpretation of granting a permit to Mr. Salinas. You new tell me the
permit was issued very late on Tuesday - January 21" and to no surprise Mr. Satin -as had concrete trucks
on site the next morning at 7 am. pouring his wall.
The slightest common sense and seeming standard procedure that any professional city office would be to
first address the person who filed a complain% even if it was not in his or her favor, before a permit was
issued. Keep in mind your staff required me to fill out a formal complaint on this issue. From December
at f
10, 2002, and every couple of days thereafter I either stopped by or c led your of ice to ge updates I
talked to either you, Kathleen Taylor or Ann Bulfis. It is unconsuable to me that you and your staff
overlooked the fact that I was to be contacted upon this permit being issued. A permit. that had as much
discussion and debate a-, this one did and not even call or letter was issue until after the work was
completed. Only when I called you and Mayor Haakenson did your letter finally appear.
Furthermore, I asked you weeks ago if you allowed the wall remain at. the current height, and I appealed
your decision what would you do. You also stated to me that you would be "hard pressed" to allow this
to go forward having this issue "unresolved" and knowing that I could file an appeal that would then go
to the Hearing Examiner. I realize, at least I think I still have that tight even your statement of possibly
stopping work on the wall no longer holds true.

You also made an untrue statement when you stated to me and to Mayor Haakenson that I had the same
legal option now as I did a month ago, untrue. I have had no option and I could not make any decisions
on what to do next until you issued the permit. At one time, you and your staff lead me to believe that
you may make Mr. Salinas lower his wall. Another time you said he could probably do it but you would
never give me the exact ECDC that would allow it to happen. If you issued the permit and required Mr.
Salinas to lower his wall then I clearly would not have had any ftirther issues.
You state "Definition 21.90.150 Structure" aflows Mr. Salinas to add an additional three foot "retaining
wall". Key word being "retaining wall". Ye% in "Definition 21.30.020 Fence" it clearly states "Any portion
of a base or foundation for the fence which does not serve as a bQna fide pwposic QUctaining-cwth
shall mt bc cQuiii[der—ed a EcIaMmug waff but rather a part of the fence." In that case, per zoning
regulation 17.30.000 C - a variance must first be obtained. You have allowed a Yl 1 " retaining waIl then a
Y backfdl wall and then a 4? fence/wall totaling 10'11". Bona fide means "being exactly as appears" and
furthermore it states "retaining earth", not back fill. The extra Y that you are allowing is not only =
retaining earth but it has never "exactly appeared!' to retain earth like the "lower T11" retaining wall".
Thus, it shall not be considered a retaining wall but rather part of the fence. YOU SHOULD NO`I*
HAVE ISSUED THIS PEMIT as you did. You still have not addressed this point and explained why it is
not valid, I do not feel that anybody after seeing this wall would say that doing this was within the intent
of any of the definitions or ordnance's. This is in addition to the other disputed grade elevation issue.

The way you and your staff handled this at the end leaves many unanswered questions. What would have
been the harm in allowing this issue to run it course legally without allowing work to be done just on the

west wall. Keep in mind I have never asked for work to be stopped on the house but only on the west
wall. I am not sure; if an architect, who, you may feel, knows more about your own definitions and
ordinances, intimidated you into pushing this through, or is it just small town politics. Kathleen Thylor did
tell me that architect Mr. Waite has done many "approved" projects with the City of Edmonds, and
"knows what he is doing". I most certainly now feel you were playing both side of the fence, so to speak,
and when I turned to my city government to protect my property you turned your back. Is it not the
intent of ordinances and city codes to protect the property owners of the City of Edmonds? If so, why
do I now have a "freeway wAP' on my property fine? If the City of Edmonds allows this type of
manipulation of its codes and thinks it is okay, then we are all in trouble. just look at the results and tell
me it look s just fine. Please respond A-S.A.R so that I once again do not miss out my legal options.

C. The Boe's property under the same short plat and topographical layout as the Salinas property. Nicely conftirming to the
neighborhood and not raised three extra feet Now because of your ruling the fine property could raise their lot three feet
