Dear Mr. Cole:
The purpose of this letter is to inform you as the registered agent for this property that a serious code
violation has occurred that demands your immediate attention. For your information, on 7/24/02 Cobra
Construction submitted a permit application on behalf of Galleon for re -roofing and parapet extension.
During review of the application the City Planning Division informed Cobra that a height variance would
be required for the parapet. Please note that as of this date no variance application has been submitted to
the City for review, nor has a building permit been granted for work on this property.
On 9/25/02 the City Building Inspector issued a "STOP WOIW' correction notice because the re -roofing
ai
and Parapet work W commenced prior to permit issuance. A building permit is required pursu it to
Uniform Building Co de Section 106 and Appendix Section 1515 and 1516. Building code violations . are
subject to Civil Penalty fines as well as misdemeanor penalties. On 9/30/02 the architect for the project
in
Mr. Mike Nickerson contacted my office and confir ed that the project was approximately 75%
complete. As a follow-up to that conversation the City Building Inspector posted the site today with the
enclosed Order to Correct Violation Notice and discovered that work is continuing in defiance of the
STOP WORK order.
Please be advised, the posting of the Order to Correct Violation Notice is the first step in the City's civil
penalties process whereby fines of $ 100.00 per day shall be assessed if work continues contrary to the
STOP WORK order. Also be advised the City Police Department shall visit the site for the purpose of
recording information of workers who are violating the STOP WORK order. This information shall be
forwarded to the City Prosecuting Attorney's office.
It is not the City's intent to cause you and property owners of Galleon Condominiums undue hardship,
however compliance to the codes is mandatory. for the fair and equal treatment of all citizens. If workers
are on site performing any work that requires a permit the City shall immediately issue a Notice of Civil
Violation and fines shall begin to accrue at a rate of $ 100.00 per day until this matter is resolved to the
satisfaction of the City.

Description of Violation: A building perrnit..application was submitted on 7/24/02 on behalf of Galleon

review correction indicatiniz that a variance was required for the work. The applicant. to. date has not
submitted.a variance application. On 9/25/02 the City Buildiniz Ins-oector issued a "STOP WORIC'
correction notice because the noted work had commenced Prior to pennit issuance. On 9/30/02 the
arcbitect for the project Mr. Mike Nickerson confirmed that 75% of the proiect has been cowleted.
Corrective Action Required: 1) STOP WORK. 2) Make complete application for a Variance, OR 3
Remove all illegal work including the paravet with a valid demolition permit and 4) Change the plans on
file with the City such that a variance shall not be required. Note double gpplication fees shall be
assessed if a variance is required. Contact Star Campbell, City Planner if you have any questions
regarding the Variance avolication.
Correction is Required no later than: 5-OOpm
