Dear Mr. Henderson:
The City is in receipt of your letter dated September 8, 2003. As the Director previously
informed you by his letter dated September 5, 2003, you need to understand that what you
believe to be true about your house height (that the existing addition height is less than the
original building height) must be verified.
The City process for verifying height is for the applicant to provide height calculations as shown
in our public handout (additional copy enclosed). The previous height information that you
provided is not satisfactory in detail. However, we are offering to help you by proposing to have
our Building Inspector meet you on site to perform a height check of your residence. At the
same time our inspector could verify the carport setbacks (which he needs your assistance in
confirming the property lines). But, in order for the City to -perform this task we need your
pennission to enter your property. You must decide by September 30, 2003 in order to avoid the
City Civil Penalty process.
To clarify —the City is not, and would not, fine you because of your letters. You have the
potential to have fines assessed under our Civil Penalty Ordinance (that we use as a last resort) to
rmits, you have violated a
gain code compliance. For the work you have done without proper pe
City zoning code and State Building Code by performing remodeling on your home without first
obtaining a building permit and by installing a carport without a building permit (possibly within
setback areas). Please re -consider our request to have the City Building Inspector measure your
house height so that the building remodeling permit can be issued. Also, please re -consider and
allow our inspector to measure your carport so that setbacks can be confirmed.
The City has a signed permit application on file for the carport, we have a building permit
application for the remodeling (but this needs to be signed by you). The application can be
signed at City Hall, Monday through Friday, 9:00am to noon and 1:00pm to 4:00pm.
Regarding your complaint on 520 Dayton Street, no such building number exists in our system.
If you have another address I am more than happy to investigate your allegations.

1 feel obligated to respond to your latest letter. I will reiterate my position n this matter.
You choose to do work on your home without proper permits and must now obtain the
proper permits. City staff has sent nineteen letters to you. While you may believe we
have been non-res'ponsive, I believe my staff has gone way out of their way to assist you.
City staff is only trying to work with you to gain compliance with adopted city code. I
offered to have staff help you with the permitting process which they have done. As an
example we have offered to verify the building height and carport setbacks rather than
have you hire someone to do the work. Either give us permission to enter your property
to take the measurements or hire someone to do the measurements and submit them to the
city.
We have held off issuing a Notice of Violation (NOV) to allow you to obtain the
necessary time to obtain the proper permits. You have been told what needs to be done to
get the permits issued. Please let Jeannine Graf know by September 19, 2003 whether or
not the City has your permission to make the height and carport setback measurements.
If we do not receive your pen-nission and do not receive the requested height and setback
calculations by September 30, 2003, City Staff will have no choice but to issue a NOV.
Once a NOV is issued fines of $100 a day begin to accrue. I do not want this to occur
since we are so close to getting the permits issued.

Regarding your statements that we have not investigated your previous complaints of illegal
building construction in your neighborhood please refer to attached City letter dated 10/22/02.
As a result of this investigation two of your neighbors were detennined to need a building permit
and both have obtained the proper permits. There were three other neighbors that were
investigated but were deter -mined not to need building permits. If you have knowledge of other
illegal construction activity at specific sites in the City, you may bring those to my attention by
completing and submitting a land use complaint form. Once we receive your complaint we will
investigate the allegation and any violator'found performing construction work without a valid
building permit will be issued a 'Stop Work Order' and be assessed violation permit fees. It is
the City's intent to treat everyone fairly and equally by requiring building pen -nits.
Regarding traffic visibility and your carport location, please refer to attached City letter dated
March 14, 2003 that satisfactorily responds to your exit issue on this matter. The City Traffic
Engineer has determined that no traffic hazard exists as long as required minimum carport
setbacks are maintained. The issue of carport setbacks from property lines is not a discretionary
determination --all structures are required to meet minimum setbacks or a variance must be
granted by the City Hearing Examiner.

Dear Mr. Henderson:
The purpose of this letter is to again inform you that outstanding plot plan and setback
information are holding up the issuance of your building permit. These items are still
outstanding from Kathleen Taylor's January 22, 2003 plan review corrections and most recently
the corrections she issued you on April 29, 2003. Please contact her directly if further
explanation is necessary in order for you to resubmit the required information. Please note no
fin-ther review can take place on your permit application until you provide this information to
Mrs. Taylor.
Unfortunately, I must insist that you submit the outstanding information by May 23, 2003 or I
will again be forced to reinitiate civil penalty fines. As stated in my letter dated December 19,
2002 (copy enclosed for your convenience) the Director suspended the civil penalty fines

First, let me inform you that Jason Tourtellot no longer works for the City. You may want to
alter your mailings to reflect this employee change and please feel free to continue to write or

By the direction of the Director, I am providing this in response to your latest letters to the City, I
shall attempt to respond to your concerns and questions.
• I have enclosed the City's handout entitled "Appeal Procedure", a Land Use application
form andan Adjacent Property Owners form. I have also enclosed Edmonds Community
Development Code Chapter 20.110 which is the code chapter that describes the
enforcement appeal process. If after reading the materials you have any questions please
feel free to contact me. If it is your intent to appeal the Notice of Civil Violation the
Director has extended your appeal deadline to December 13, 2002. If you fail to submit a
complete appeal application by 5:00pm December 13, 2002 you shall forfeit your
administrative appeal rights in this matter and fines shall be assessed. A complete
application includes a letter of appeal and fee of $500.00.
• Regarding the un-signed complaint received against your property, as I understand your
position, because the complaint filed was not on the official City 'Land Use Complaint
Form' and unsigned, you believe we initiated enforcement 'illegally' against you. As
explained to you in City letter dated 6/20/02 we do not assign our field inspectors to drive
through neighborhoods searching for code violations. We don't have to because we have
a very active citizenry who are willing to file complaints of illegal permit activity. As the
Director and I told you in our meeting in October, we Prefer to have all complaints
submitted on the City Land Use Complaint form however, we do investigate complaints
via letters, electronic mail, or via the telephone. But regardless of how we are informed
of a potential violator we still attempt to verify the validity of the alleged complaint by
performing a site inspection, which we did in your case.
• Since you have a copy of the complaint filed against your property, you know it states,

the alley.' Once we received this complaint, we assigned our City Building Inspector
Mike Snook to perform a site inspection of your property to attempt to confirm alleged
violations. The inspection was done on April 4, 2002 and the only work that he could for
certain note as a code violation was the carport/garage structure. He posted a Correction
Notice on the carport (copy enclosed for your convenience) requiring you to apply for a
building permit within 10 days or remove the structure.
You responded to the Correction Notice by coming to City Hall on April 8, 2002 and
Lara. Knaak our Permit Coordinator provided. you all the applicable handouts for a
garage. When you returned to the City on April 12,2002 you met with Jason Tourtellot
who spoke with you regarding the other alleged work as described in the complaint (the
bays, 2 nd story additions, roof porches, etc). It was at that time that you verbally
confirmed such work to him. As you already know, City Building Division employees
are not required to provide a Miranda reading on your rights, since your actions
(remodeling and repair work) were not felonious in nature. At that meeting Jason asked,
and you agreed to provide a written scope of remodeling work by April 19, 2002. It is
clear from the tone of your letters.that you are displeased that you acknowledged such
work to the City but the scope of work you provided did allow us to identify what permits
and approvals were required and moved you closer to resolution of this matter.
Here are the facts to date:
o On 4/l/02 the City received an unsigned complaint that clearly indicates your
property address of 639 Walnut and alleges remodeling work and a garage on the
property line.
o The complaint states 'this neighbor lives at 639 Walnut. He has been building on
his house for years -adding bays, very odd 2 "d story.additions, roof porches. But
now he has built a garage right on the alley.'
o In response to the complaint our Building Inspector performed a site inspection on
4/4/02 and wrote a correction notice on the carport structure.
o On 4/8/02 you came to City Hall and were provided with a permit application and
the Garage permit submittal handout.
o On 4/12/02 you came to City Hall and met with Jason. At that meeting you
disclosed to him the remodeling work that you performed on your house without a
building permit. You agreed to provide a scope of work.
o On 4/22/02 you provided a detailed scope of work to the City. Based on this
information Jason wrote you a letter on 5/16/02 stating that you needed to apply
for a remodeling permit and a carport permit.
o On 8/5/02 you submitted a building permit application for interior remodeling.
o On 10/21/02 you submitted a building permit application for the garage structure.
Please be advised, as Building Official for the City of Edmonds, I am obligated to pursue this
matter until all the proper building permits are obtained and all required inspections are
performed and signed off. This is my duty under City and State law. The goal of the City is to

Thank you for taking the time to meet with myself and Duane Bowman, Development Services
Director, at the City. As promised, this letter will list what you need to do to get your building
permits.
1 . See Attachment One'. This green form is called a Critical Areas Checklist. The checklist
is required by the State to verify that there are no environmental issues on your property.
I have highlighted in'yellow the parts that you need to fill in. There is a $45 review fee
lot to verify no environmental issues
for this document. A City Planner will inspect your
exist such as wildlife, streams, and old growth timber. At this time we do not anticipate
any environmentally problems on your ' lot. Fill out the form and return to me with a
check for $45 made payable to the City.
2. See Attachment Two. This is our Height Calculation Handout which explains how the
height of buildings is calculated in the City. Because you changed the roof pitch,(made it
higher) you must submit height calculations to prove you are still under the maximum
height permitted by code which is 25 feet. After reading this handout you may need to
have someone assist you since a leveling instrument is required to calculate the height.
Or, you can come to City Hall and I could explain the process in more detail. Follow the
sample plan that shows how to measure the height of the house and submit this
information to me for review. If the house is over height a variance would be required in
-order to approve it.
3. You have already filled out a permit application for the carport please bring it with you
on your next visit to City Hall as we will use this form to review your carport.
4. The next time you are in City Hall I need you to do the following:
a. Sign all permit applications you have submitted to the City
b. Sign a form that states you performed all work on your residence

c. Tell me how much money you have spent on your projects. The reason I need
this information is because this is how the City calculates the permit fees. Since
some people do all the work themselves and some people hire out the work we
must use a fair market labor and materials price for the work you have performed.
5. You 111 meet with a structural engineer at your house to show him what work you have
done iiiside the house. The engineer may require that you take off some sheetrock to
show the size of beams or how you connected beams. We recommend that you wait and
only relmove the sheetrock that the engineer tells you to and leave these areas exposed
until th� City Building hispector gives you the approval to re-sheetrock.
The engineer will then write a letter to the City that either says the work is approved or
the work needs to be altered. If the work needs to be altered the engimw must give the
City a plan that shows what will be changed. The City will review the plan and then
issue a permit for the work and our City Building hispector will inspect all work before it
is covered up with sheetrock.
Any o�her recommendation that the engineer makes about the house is your decision as to
how ybu want to proceed. The City is not telling you to demolish the house. Our goal is
to have yoii get all required permits for the work that has been done and to be.sure that
the house is safe and habitable. However, it is like . ly that some sheetrock may have to be
removed in order for us to be sure that the house is safe, the City Building Inspector will
make that determination after the permit is issued.
6. The carport driveway sight distance issue (plan review correction dated 9/13/02) has been
sent to our City Traffic - Engineer for re -consideration. We will tell you his decision at a
later time.
7. Regarding any sewer work that you may have done on the house and property. Sewer
lines within the walls of the building that are repaired need a plumbing permit. Any
sewer lines outside of the walls of the building that were repaired needed a sewer permit.
The next time you come to City Hall you need to tell me what work you did on any of the
plumbing in your house. At that time we can decide what kind of permit you need.
8. Once all the information is submitted to the City we have a process for review. The
Engineering Division reviews for storm drainage requirements, site distance hazards, etc.
The Planning Division reviews for compliance to bulk zoning standards which includes,
setback distances from property lines, maximum height of structures, lot coverage, etc.
The Building Division reviews for the structural integrity of the remodel or construction,
non-structural life safety hazards and energy code provisions.
After review of'all Divisions if additional information is required a 'Plan Review
Correction' is issued outlining the outstanding information. If after plan review no issues
are discovered that reviewing Division will approve the permit for issuance.

The purpose of this letter is to acknowledge your letter received August 13, 2002. Your
letter appeared to be addressing a miscommunication regarding permit requirements and
claims that an invalid complaint was received. Additionally, you suggest being treated in
a manner unconstitutional and mention an interest in appeal.
To begin with let me clarify, the City is not telling you to tear down your residence as
you indicate in your letter. Further, at no time did the City ever indicate it a priority to
tear down your residence so that you may comply with -the code. The City is only
interested in making sure that you obtain proper building permits for those unpermitted
improvements you've already identified. To date, you've submitted information to
partially corriply with a complete building permit application submittal.
Regarding the miscommunication of permit requirements, at no time did the City state
that permits would not be required for either the carport or the remodeling of your home.
In fact, during our first conversation at City Hall, we discussed your options if your work
does not meet current code. Even after you prepared the drawings indicating all the work
you had already performed, I explained what permits would be required and suggested
that you submit both your remodeling and your carport permit applications at- once to
eliminate any undue confusion. Currently, both your remodeling and carport permit
applications are considered received but remain incomplete,.
You need to submit the following information for the City to consider your building
permit applications complete:
• Please submit a written bid from a licensed contractor or a list of materials for all
interior remodel work.
• Please fill out and submit the enclosed owner exemption verification form if a
licensed contractor did not perform the unpermitted improvements to your
residence.

solution to the height calculation information request made by our Planning Division. We
propose to have our Building Inspector meet you on site to perform a height check of your
residence. if you are agreeable, our inspector would measure your residence and transfer this
information to your plans. Once verified that the structure is less than 25 feet from average
grade, the planner could approve your permit application for issuance.
Since our inspector would be orf your property he could also verify the carport setbacks at the.
same time (as you recall the City Engineer has determined that the existing location of the
carport may remain --provided, that required minimum setbacks from property lines are met.)

Regarding your statements that we have not investigated your previous complaints of illegal
building construction in your neighborhood please refer to attached City letter dated 10/22/02.
As a result of this investigation two of your neighbors were determined to need a building permit
and both have obtained the proper permits. There were three other neighbors that were
investigated but were determined not to need building pen -nits. If you have knowledge of other
illegal construction activity at specific sites in the City, you may bring those to my attention by
completing and submitting a land use complaint forill. Once we receive your complaint we will
investigate the allegation and any violator found performing construction work without a valid
building permit will be issued a 'Stop Work Order' and be assessed violation permit fees. It is
the City's intent to treat everyone fairly and equally by requiring building pen -nits.
Regarding traffic visibility and your carport location, please refer to attached City letter dated
March 14, 2003 that satisfactorily responds to your exit issue on this matter. Tile City Traffic
Engineer has determined that no traffic hazard exists as long as required minimum carport
setbacks are maintained. The issue of carport setbacks from property lines is not a discretionary
determination —all structures are required to meet minimum setbacks or a variance must be
granted by the City Hearing Examiner.

Regarding your question of 'how far back can the City go on illegal constr ction work' the
simple answer is --there is no statute of limitations. Construction work is subject to the adopted
code requirements of the timethat the construction took place. For example, the first building
code was adopted by the City in 1956 but prior to that time the County had an adopted building
code that regulated construction activity. Clearly, the work that you have done to your house
over the last decade required a building permit and the City is obligated to pursue enforcement
and require a permit.
Lastly, height calculations are still required before we can issue your pen -nit. We still need a site
plan showing the smallest rectangle of the building, four comer elevations of the building,
average grade, actual and maximum, building height. If you need assistance in preparing the
plans there are local designers familiar with our height code that can assist you. The purpose of
requesting height calculations is to determine that you have not exceeded the City's height limit
of 25 feet for residential property.
If you have any questions about preparing the height calculations, Mrs. Kathleen Taylor, Planner
is available to assist you. Please submit all land use complaint fonns directly to my office for

The purpose of this letter is to again inform you that outstanding plot plan and setback
information are holding up the issuance of your building permit. These items are still
outstanding from Kathleen Taylor's January 22, 2003 plan review corrections and most recently
the corrections she issued you on April 29, 2003. Please contact her directly if further
explanation is necessary in order for you to resubmit the required information. Please note no
further review can take place on your permit application until you provide this information to
Mrs. Taylor.
Unfortunately, I must insist that you submit the outstanding information by May 23, 2003 or I
will again be forced to reinitiate civil penalty fines. As stated in my letter dated December 19,
2002 (copy enclosed for your convenience) the Director suspended the civil penalty fines
provided you continue to work with the City to obtain all necessary City approvals and permits
for the work performed on your property. If you fail to provide the information for Mrs. Taylor
by May 23, 2003 the City will start the accrual of fines at a rate of $100.00 per day.

the Planning Division still cannot approve your permit applications because of the following:
I . Height Calculations: On January 22, 2003 Kathleen Taylor sent you a plan review
correction that explained outstanding requirements for height calculations. Height
calculations are required in order to determine that no portion of your residence (that was
remodeled) exceeds 25 feet in height above the average grade. We must have complete
height calculations in order to determine code compliance. Please contact Mrs. Taylor
directly and schedule a meeting in order to resolve this item.
2. Site Plan: On January 22, 2003 Kathleen Taylor sent you a plan review correction that
explained outstanding requirements for the plot plan. Because the City has never
received a complete plot plan we have been unable to determine if your carport, etc.
meets minimum setback requirements of the code. If it is determined for example, that
the carport encroaches into the setback area we will require that it be relocated on site or
you would have the opportunity to apply for a variance to keep it within setback areas.
Please contact Mrs. Taylor directly for an appointment to resolve this item.
Due to the high volume of requests made on the City Traffic Engineer's time he has been unable
to make a site inspection of your carport to render a final decision with regard to site distance.
We anticipate a final decision by March 26, 2003 and we will advise you of his decision once it
is made.
As you know, our goal is to require that you obtain all the required permits for the work that you
have done on your house to be sure that the house is safe and habitable. City staff members are
available to meet with you and work with you to resolve the outstanding items. Please submit

First, let me inform you that Jason Tourtellot no longer works for the City. You may want to
alter your mailings to reflect this employee change and please feel free. to continue to write or

By the direction of the Director, I am providing this in response to your latest letters to the City, I
shall attempt to respond to your concerns and questions.
* I have enclosed the City's handout entitled "Appeal Procedure", a Land Use application
form and an Adjacent Property Owners form. I have also enclosed Edmonds Community
Development Code Chapter 20.110 which is the code chapter that describes the
enforcement appeal process. If after reading the materials you have any questions please
feel free to contact me. If it is your intent to appeal the Notice of Civil Violation the
Director has extended your appeal deadline to December 13, 2002. If you fail to submit a
complete appeal application by 5:00pm December 13, 2002 you shall forfeit your
administrative appeal rights in this matter and fines shall be assessed. A complete
application includes a letter of appeal and fee of $500.00.
0 Regarding the un-signed complaint received against your property, as I understand your
position, because the complaint filed was not on the official City 'Land Use Complaint
Form' and unsigned, you believe we initiated enforcement 'illegally' against you. As
explained to you in City letter dated 6/20/02 we do not assign our field inspectors to drive
through neighborhoods searching for code violations. We don't have to because we have
a very active citizenry who are willing to file complaints of illegal permit activity. As the
Director and I told you in our meeting in October, we prefe to have all complaints
submitted on the City Land Use Complaint form however, we do investigate complaints
via letters, electronic mail, or via the telephone. But regardless of how we are informed
of a potential violator we still attempt to verify the validity of the alleged complaint by
perfonning a site inspection, which we did in your case.

the alley.' Once we received this complaint, we assigned our City Building Inspector
Mike Snook to perform a site inspection of your property to attempt to confirm alleged
violations. The inspection was done on April 4, . 2002 and the only work that he could for
certain note as a code violation was the carpoirt/garage structure. He posted a Correction
Notice on the carport (copy enclosed for your convenience) requiring you to apply for a
building permit within 10 days or remove the structure.
You responded to the Correction Notice by coming to City Hall on April 8, 2002 and
Lara Knaak our Permit Coordinator provided. you all the applicable handouts for a
garage. When you returned to the City on April 12'2002 you met with Jason Tourtellot
who spoke with you regarding the other alleged work as described in the complaint (the
bays, 2 d story additions, roof porches, etc). It was at that time that you verbally
confirmed such work to him. As you already know, City Building Division employees
are not required to provide a Miranda reading on your rights, since your actions
(remodeling and repair work) were not felonious in nature. At that meeting Jason asked,
and you agreed to provide a written scope of remodeling work by April 19, 2002. It is
clear from the tone of your letters that you are displeased that you acknowledged such
work to the City but the scope of work you provided did allow us to identify what permits
and approvals were required and moved you closer to resolution of this 'Matter.
Here are the facts to date:
o On 4/l/02 the City received an unsigned complaint that clearly indicates your
property address of 639 Walnut and alleges remodeling work and a garage on the
property line.
0 The complaint states 'this neighbor lives at 639 Walnut. He has been building on
his house -for years -adding bays, very odd 2nd story.additions, roof porches. But.
now he has built a garage right on the alley.'
o In response to the complaint our Building Inspector performed a site inspection on
4/4/02 and wrote a correction notice on the carport structure.
o On 4/8/02 you came to City Hall and were provided with a permit application and
the Garage permit submittal handout.
o On 4/12/02 you came to City Hall and met with Jason. At that meeting you
disclosed to him the remodeling work that you performed on your house without a
building permit. You agreed to provide a scope of work '
o On 4/22/02 you provided a detailed scope of work to the City. Based on this
information Jason wrote you a letter on 5/16/02 stating that you needed to apply
for a remodeling permit and a carport permit.
o On 8/5/02 you submitted a building permit application for interior remodeling.
o On 10/21/02 you submitted a building permit application for the garage structure.
Please be advised, as Building Official for the City of Edmonds, I am obligated to pursue this
matter until all the proper building permits are obtained and all Tequired inspections are

3. You have already filled out a permit application for the carport please bring it with you
on your next visit to City Hall as we will use this form to review your carport.
4. The next time you are in City Hall I need you to do the following:
a. Sign all permit applications you have submitted to the City
b. Sign a form that states you performed all work on your residence

c. Tell me how much money you have spent on your projects. The reason I need

this is because this is how the City calculates the permit fees. Since
some people do all the work themselves and some people hire out the work we
must use a fair market labor and materials price for the work you have performed.

done i6ide the house. The engineer may require that you take off some sheetrock to'
show the size of beams or how you connected beams. We recommend that you wait and

The engineer will then write a letter to the City that either says the work is approved or

Engineering Division reviews for storm drainage requirements, site distance hazards, etc.

The Planning Division reviews for compliance to bulk zoning standards which includes,
setback distances from property lines, maximum height of structures - lot coverage, etc.
The Building Division reviews for the structural integrity of the remo�el or construction,
non-structural fife safety hazards and energy code provisions.
After review of all Divisions if additional information is required a 'Plan Review
Correction' is issued outlining the outstandin information. If after plan review no issues

are discovered that reviewing Division will approve the permit for issuance.

Lastly, the City's goal is to require that you obtain all the required permits for the work that you
have done on your house to be sure that the house is safe and habitable. As Director Bowman
stated to you on October 9, 2002 the fines are stopped because you are willing to work with us to

I am writing in response to your letter dated September 8, 2002, which was received by
the City of Edmonds on September 11, 2002.
While I understand the concerns raised in your letter, the City's expectations for you to
comply with the above referenced enforcement action have not changed. You must
comply with the Order to Correct Violation (copy attached) that was issued to you on,
July 17, 2002.by September 30, 2002. Should you decide not to, then a Notice of Civil
Violation will, be posted. You may then submit a complete appeal application of the
Notice of Civil Violation.
Your recent letter included a check for $320. 1 am returning your check to you as I
cannot apply it to a future appeal.
Once the Notice of Civil Violation is posted you are allowed 14 calendar days to submit a
complete appeal application. Please note that once the Notice of Civil Violation is
posted, fines of $ 100 daily shall begin to be assessed until the City is able to clarify that a
violation no longer remains. Any appeal application must be submitted to . Duane
Bownian, Director of Development Services.
A complete appeal application includes the following:
Filing fee of $500, and
Completed adjacent property owners list, and
A letter outlining the basis for your appeal of the Notice of Civil Violation.
To address your questions regarding enforc ' ement procedures, Mr. Tourtellot responded
to a citizen complaint when he pursued compliance in your case. Mr. Tourtellot is not

To address the issue of an invalid complaint, let me clarify enforcement procedures as we
had previously discussed. The City's policy is to only respond to written complaints
received from the community. In your case, the City received a complaint regarding your
residence. The complaint cited a carport and several remodeling projects. It is this
complaint and your explanations of the work you performed that have obligated the City
to take corrective actions. If you have concerns about a project in Edmonds that you feel
needs review by the City then please return the enclosed complaint form so that we may
be formally notified of the situation.
Your letter also expressed an interest in appealing to the highest authority to address a
situation that you feel is unjust. Your letter cannot be accepted as a formal appeal to be
heard by the City's Hearing Examiner. If you would like to file a formal appeal to the
City's Hearing Examiner, that opportunity is provided within 14 calendar days from the
date of the posting of a Notice of Civil Violation (NOCV) at your residence. The fee to
file an appeal to a NOCV is $500. 1 have enclosed an appeal procedures handout to assist
you if needed.
As noted above, our primary goal is to insure that you obtain a] I necessary permit
approvals for the unauthorized construction that has taken place. To that end, if the
City does not receive the above requested information by September 30, 2002 then a
NOCV will be issued.

After checking on the reference in your June 9, 2004 letter, I spoke with Jeannine Graf, Building Official,
regarding the issue of opening up the walls and we do not need to do that type of inspection. We still need to
come out to do site inspections to close out the two permits. Driving by your property is not an inspection.
Again, you seem to forget that it was you who did work onyour house without obtaining proper building
permits. Yet it is somehow the City's fault that we are enforcing our codes. We have tried to work with you.
After meeting with you and understanding your financial situation, we did not pursue fines, which we could
have in this particular case. We tried to figure out alternative ways to handle the permits and gave you
guidance.
We have had your permits dragging on since your initial correction notice on April 4, 2002. We cannot ignore
the July 26, 2004 permit deadline. I again ask that you please call for inspections on these pen -nits before the
July 26, 2004 expiration deadline so we can complete the permits. You can SO . iedule the inspe I ctions by calling
the City's inspection line at 771-0220, ext. 1333.
As for colluding against you, that is your opinion. You know what to do to complete your permit applications
and I e icourage you to comply.

Development Services Department, letter dated October 14, 2002. Item numbers correspond to

1 met with Mr. Henderson and inspected the residence at the above address. At that time, I asked
Mr. Henderson to provide me with a copy of the City of Edmonds Letter, a set of plans for the
residence to include floor plans and elevations (if not to scale, then with dimensions). I was also
given pictures that were taken during the remodeling of the second floor.
I received the above information and plans in a timely fashion. I performed a lateral analysis of
the residence (See enclosure 1). 1 also performed a partial gravity analysis of the structure to
include the roof, upper floor floor joists and header in the main floor bedroom. Based on the
above information and analysis, the following will need to be accomplished:
Ridge Beam
Laminate 2-2xl 2 HF#2 beams along side the existing 2xl 2 HF#2 Ridge Beam using 1-1 6d @
6"oc (staggered) and use a 2x4 HF#2 post between the 2x4 above and the Ridge Bearn under
each rafter.
Floor Joists
Mr. Hend erson to pick a section where the size and type of joists and either the rim joist or solid
blocking can be inspected. If there is no rim joist or solid blocking, solid blocking will need to be
installed between each floor joists within 1 foot of the end of the joist.
