As you are aware, the last remaining issue is to resolve the remodeling of the garage into habitable space. Although you have provided compelling evidence that the work was performed some 18 years ago, City permit records do not indicate that a permit was issued for this work. The purpose of the building code and issuance of permits is to ensure that construction is built to mimmum life and safety standards. Although you are confident that the existing construction is adequate our inspection (performed under an issued pen -nit) would confirm your assumptions and resolve the matter. However, you also would bear the responsibility of fixing a problem, if construction was not code compliant. I am very pleased that you are considering obtaining a remodeling permit in order to move toward resolving this issue. As we discussed on the phone, for example, if the work was valued at less than $2,000.00 the permit fees would be less than $200.00 (violation fees are not assessed since you did not perform the work). If you intend on submitting for the permit, enclosed is a building permit application form, this form and the fees would need to be returned and once issued, the City would request that you schedule for an inspection within 30 days. As I mentioned today, the Building Inspector would require that some sheetrock be removed to verify stud wall construction, plumbing, electrical, etc. is to code. Lastly, after our telephone conversation today I spoke to Michael Thies, Code Enforcement Inspector, and he still desires to inspect your residence to confirm that there is no accessory dwelling unit. Graf Building Official Dear Ms. Graf: I am writing in response to your correspondence with Mr. Mark Corley, of May 19, 2004. With respect to the alleged unpermitted Accessory Dwelling Unit (ADU), an alleged violation of Section 16.20 of the Edmonds Community Development Code, in the garage portion of his residence, Mr. Corley wishes to agree that if the inspection to be conducted on June 15, 2004 reveals the home is configured to accommodate two separate dwelling units, he will sign an ADU Covenant acknowledging that only one family may reside in the home. Regarding the remodeling of the garage into habitable space, Mr. Corley has agreed that he will submit to the City, a building permit application, floor plan and section view of the remodeled area, and permit fees by June 1, 2004. Mr. Corley agrees that he will correct any code deficiencies noted during the inspection within 30 days of the inspection. Mr. Corley contacted Don Millar, Supervisor for the Electrical Section, Washington State Department of Labor & Industries, Electrical Permits Certification &, Inspections, Everett Office (729 100th Street, S.E. Everett, Washington 98208) as well as Ralph Hardesy, Electrical Inspector, Washington State Department of Labor &' Industries, Electrical Permits Certifications and Inspections, of the same office. Both Millar and Hardesy told him that the Department of Labor &, Industries, Electrical Division only keeps records of electrical permits, certifications, and inspections for the last ten to fifteen years. Mr. Millar and Mr. Hardesy told Mr. Corley that assuming the remodeling work done at 23805 79th Avenue West Edmonds, Washington 98026 was performed at least eighteen years ago, the Department of Labor & Industries has no records for the electrical component of the remodeling work at issue.
