the shared driveway pavement. Accompanying City officials were representatives of

Landau Associates, professional geotechnical consultants for the City who prepared a site

report based on their observations (copy enclosed).
Please note that the primary purpose of the geotechnical site investigation. was to determine

if the cut slope and sloughing created an impact to tile adjacent driveway. As stated in the
Landau Associates report, it is their opinion that the excavation oil Your lot exceeds a

2:11-1/V slope is overly steep, and threatens tile northerly shared driveway. Landau's

recommendations include that vehicle traffic should be limited from access oil the

southerly 6 feet of this shared driveway.

As the owner of the lot under construction and responsible party for this excavation, you
are responsible for slope protection and associated mitigation and/or safeguards in this
matter. Pursuant to Uniform Building Code Section 3307, entitled Excavation and
Grading, as Building Official for the City of Edmonds, I shall require tile following:
0 Immediately install lighted barricades along the length of the access driveway
reducing tile width by six feet. The barricades are to remain in place pending tile
outcome of your geotechnical report (explained in detail below). If tile report

Dear W Gebett:
At your request, Dennis Stettler of Landau Associates and Dave Gebert of the City of Edmonds
observed an excavation fo;r a future residence at 18019 69"' Place W. on the aftemoon of September 13,
2004. The purpose of the visit was to assess potential excavation slope stability concerns that could
impact the adjacent drive*ay.
OBSERVATIONS I
The excavation conditions were observed from the private driveways bounding the property on
the north and south sides. We did not enter the excavation. At the time of ourVisit no construction work
was being conducted and'it was rairing- Rain had been falling intermittenfly overnight and during the
daylight hours preceding our site visit. A temporary, moveable wood fence was present along the south
side of the north driveway. The driveway is about 15 ft wide and asphalt paved -
The excavation for the basement of the proposed residence extended down into what appeared to
be gray, glacially -consolidated soil. Brown soil that appeared to be topsoil was present between the gray
soil and rmunants of a sod line that wert; visible around portions of the excavation. Fill appears to be
present in some areas, in particulu the upper portions of the north side of the .-xcavation appear to be fill.
The north side of the excavation is near -vertical for the lower approximately 4 to 5 R., steeply sloping
above the ne�ar-vertical slope, then near -vertical again for the upper portion of the slope. The top o E the
excavation on the north side comes up to the edge of the pavement for the driveway that services
residences north and east'of the subject excavatiom The soil exposed in the. upper portion of the slope
beneath the pavement appears to be angular quarry spall material that is sloughing into the excavation.
During the brief time of our site visit� portions of the quarry spall material and a small segment of the
near -vertical excavation in the gray soil near the base of the slope were observed to slough into the
excavation.

the excavation on the cast and west sides. We, understand that this waterline services the residence to the
cast and the line was broken during excavation for the basement and bas been temporarily repaired.
Portions of the waterline are suspended in air as the pipeline traverses betwean the excavation sides and
the bottom of the excavution.
EXCAVATION STABILM
The excavation conbdw near -vertical portions and the overall slope inclination appears t:) be
signiricantly steqw than a 2H:lV (horizorital : vertical) slope. In our opinion, the excavation is overly
steep and threatms the adjacent driveway to the north. Sloughing and fidlure of umterial into the
excavation could be expected to continue and could undermine the south portion of the driveway on the
north side of the excavation. This could present a hazard to vehicles traversing the driveway. In our
opinion, the present si"on presents a danger to any vehicle traversing the south side of the 15 ft wide
driveway. At this time, we mornmend that Ihe temporary fence or other temporary barricades be moved
so that vehicle traffic is pievented frorn access to at least the southerly 6 ft width of the driveway. It will
also be important that thl e driveway be monitored for signs of cracking or settlement that could be
warning signs of movement that could further endanger the stability of the driveway. If such sips are
observed, it may be appropriate to prevent all vehicle traffic on the driveway imtil the adjacent excavation
is backfilled or otherwise� stabilized by shoring.

note that the excavation i i s steeper than that prescribed by WISRA, and according to WISHA excavation
requirements (WAC 296j.1 55), should either be flattened or temporary shoring- provided.
WATE:F,LWE STABELITY
The waterline has been temporarily repair .4 but is presently expo.jed and partially sus-pended
near the base of the excavation, Should sloughing of the excavation side slopes or movernent of
construction equipment damage and break the waterline, the release of water could potentially result in
erosion of the slopes at the base of the excavation and Rather reduce tho stability of the temporary
excavation. it would be prudent to protect and relocate this waterline as soon as it is practicable.

If correction is not made by the date and time specified in the Order, a Notice of Civil

Dear Mr. Seitz:
The City is in receipt of your letter dated September 20, 2004 that details Your actions to date on above
referenced Lot 17 and your work schedule for the next week and one half. Your proposal is to forgo
geotechnical evaluation required in the Order to Correct Violation Notice because; you have addressed
City concerns in a timely manner; you have not observed any sloughing of tile shared driveway; and
you will restore the shoulder of the shared driveway so that the slope will not exceed a 2:1 slope such
that no additional engineering is needed.
The City remains concerned oil the issues outlined in my letter dated September 14, 2004 but will
-oundation walls and backfill the driveway shoulder
allow you to proceed with your plan to form tile f
area, provided; that daily monitoring of the site for adequate temporary erosion control measures
continues, that any observed driveway sloughing, movement or failure is immediately reported to the
City Engineer, and that geotechnical evaluation (to be perfon-ned by a state licensed geotechnical
engineer) takes place on the compaction of the driveway shoulder area. This required engineering
inspection is not an appealable or negotiable decision by the building official and is required due to the
fact that the fill will support the driveway surcharge and adequate compaction is critical.
The City expects that the foundation walls will be poured by no later than Friday, September 24, 2004
and that the complete backfill of the driveway shoulder area and special geotechnical inspection on
compaction shall be completed by no later than September 29, 2004 (with the report to be Filed with

the City by no later than October 1, 2004). If any of these time lines will be exceeded you are required
to inform the City in writing prior to the deadline. Failure to notify the City shall result in the issuance
of Notice of Civil Violation whereby fines of $ 100.00 per day shall be assessed.

We have installed the barricades and erosion control measures outlined in your correction notice
dated September 15, 2004.
We have met with you engineering inspectors onsite on the 15th and 16'h and have made minor field
corrections and have received approval for erosion control on the 16'h.
We received app roval from the building department on Friday morning the 16th and poured
fbotings that afternoon.
We are removing the footing forms today and will deliver wall panels tomorrow the 2 1' and begin
building the walls and anticipate requesting inspection Friday morning the 24th and hope to pour them that
afternoon. After pouring walls we will need a few days to remove the forms and waterproof the walls. I
anticipate beginning backfill on about the 29,h of September.
I believe we have addressed the City's concerns in a timely manner and will be restoring the
shoulder of the adjoining driveway so that the slope will not exceed a 2:1 slope. It does not appear that
there has been any sluffing of the driveway in question. Furthermore the backfill will be restored in such a
manner that I do not see the need for additional engineering.
I hope that this will provide you with a schedule as to what we have planned. I want to assure you
that we are checking our erosion measures daily and will be diligently pursuing completion and restoration
of this site.

RE: Excavation in the area of private driveway at 18017 6 PL W MO.
Dear Linda:
As we discussed last week in our telephone conversation on the above subject, I had our
inspector visit the site to look at the situation and determine if there was any degradation
of the driveway due to the adjacent construction. Our inspector looked at the site and
reported there was no undermining and the area between the wall and driveway is now
partially backfilled and compacted and the contractor was in the process of installing a
block wall. Although there had been some undermining prior to the wall going in, there
was no evidence of problems. The reason the area hasn't been totally backfilled is
because they are still working on the wall and the contractor has to relocate one of the
water service lines that feeds the house directly to the East of the construction. Based on
field observations, the water service will be located between the block wall and the
driveway. Before the contractor can backfill the water service line, we must inspect it.
According to the inspector, the block wall will not be very high and the contractor will be
required to backfill behind the block wall at a 2:1 slope (2' horizontal for every foot
vertical).
If there is settlement in the driveway as a result of the construction, the contractor will be
required to fix the problem prior to our sign off of the pen -nit
Please note that should settlement occur after we sign off on the building permit, the issue
will be between you and the contractor and or homeowner to resolve.

Dear Mr. Seitz:
We have reviewed the letter dated March 2, 2005 from Liu & Associates, which you submitted
to the City on March 4, 2005, concerning the subject retaining wall. The conclusions in the letter
do not satisfy our requirement that the engineer clearly state that the existing wall does not
support a driveway surcharge. In our meeting with you on March 1, 2005, we explained to you
very clearly that the immediate question that must be answered regarding your retaining wall is
whether or not a permit is required. We explained to you that the determining factor as to
whether a permit is required is whether or not the retaining wall supports surcharge from the
adjacent drivewU. Our observation, based upon the close proximity of the retaining wall to the
driveway, is that it does support surcharge and that, therefore, a permit is required.
If you wish to pursue a determination that a permit is not required, you must submit an
evaluation and report from a geotechnical engineer that demonstrates that the retaining wall does
not support a surcharge. Upon receipt of this evaluation and report, we will submit it for peer
review, for which you will be required to pay a peer review fee. The evaluation must include
corresponding calculations and dimensioned drawings for peer review approval; OR, if you
agree that the retaining wall supports a surcharge, then you must submit an application for a
permit and include all required submittal information (refer to Retaining Wall Permit Submittal
Requirements) including appropriate fees. Note, peer review will be required.
On Friday, March 4, 2005, you asked the City Engineer if the City would accept a bond for the
retaining wall. This request has been reviewed with the Director and has been determined that a
bond is not appropriate in this situation and, therefore is not an acceptable alternative.
Lastly, I remind you that occupancy prior to final occupancy approval is a violation of the
Building Code and is subject to fines.

Dear Mr. Seitz:
Regarding the driveway retaining wall design and surcharge issue, the City's geotechnical consultant Landau
Associates, Inc. has completed review of Mr. Liu's, P.E., submittal and a copy of their review letter dated March
24, 2005 is enclosed. Please note that Landau concludes that the series of retaining walls were not built in
accordance with the manufacturer's specifications and the upper wall imposes a surcharge on the lower wall in
the two tiered system. It was also noted that the walls are not constructed to City approved design standards.
Because of these issues it is the decision of the City that the entire wall be reconstructed under a building permit.
Please be advised that the new wall shall be designed per manufacturer specifications as well as City design
standards. Engineering calculations shall be provided to justify the design. The City shall utilize Landau
Associates to perform the future design peer review and you are responsible for the peer review fees. Once the
permit is issued the City shall require special inspection and geotechnical evaluation (to be performed by a state
licensed geotechnical engineer) during the course of reconstruction and work must be completed within 30 days
of permit issuance. Enclosed is a copy of the City's handout for Retaining Walls.
Pursuant to your request, temporary occupancy may be granted while you are progressing with correcting the
driveway retaining wall condition. If temporary occupancy is granted by the City a bond for the reconstruction
of the driveway retaining wall shall be posted in the amount of $10,000.00, (bond form previously provided to
you) prior to temporary occupancy approval.

In accordance with your request, Landau Associates completed a geotechnical engineering peer
review of correspondence and typical cross sections prepared by the developer's geotechnical engineer
related to modular block gravity walls constructed near the north and northwest property boundaries at
18019 690'Place West in Edmonds, Washington. This review was conducted under Landau Associates'
On -Call Geotechnical Engineering Services Agreement with the City of Edmonds and Task Order
No. 05-02.
We have reviewed a letter prepared by Liu & Associates dated March 2, 2005, a letter from the
City of Edmonds dated March 7, 2005 requesting an evaluation of the surcharge influence of traffic on the
adjacent driveway, and a response letter from Liu & Associates dated March 21, 2005. We have also
reviewed a hand sketch of dimensions and elevations of the existing wall configuration prepared by Lyle
Chrisman Of the City of Edmonds to better understand the overall configuration and heights of the
existing wall.
Landau Associates concurs with the findings and conclusions of' Liu & Associates'
March 21, 2005 letter that addresses the influence of the driveway traffic surcharge and concludes that the
driveway should exert ii-Linimal or no surcharge pressure oil the block wall given the most critical section
described in the letter prepared by Liu & Associates.
However, Landau Associates is concerned about tile overall configuration of the wall and in
particular the configuration of the two -tiered wall system. It is our opinion that the upper wall, which is
set back from the lower -tier wall a horizontal distance less than the height of the lower -tier wall, Would
impose a surcharge on tile lower wall in this two-tier wall systern. We agree with the statement ill
Liu & Associates March 2, 2005 letter that "tile general rule of thumb is that the Lipper -tier wall should be

Once the retaining wall is completed the bond will be released and final occupancy may be granted.

Dear Ms. Vrudhula:
During the construction of a residence on Westar's property located at 18019 69" PI W (the
"Property"), Westar encountered a water -line, which serves your property, well within the boundaries of
the Property. At considerable expense, Westar attempted to relocate the water -line in order to satisfy the
requirements of the City of Edmonds. The City of Edmonds has imposed additional requirements that
Westar is unable to comply with as the water -line was installed improperly by your contractor.
In addition to the above, your contractor failed to obtain an casement from Westar prior to
placement of the water -line on the Property; therefore, the reason for this letter. Westar hereby demands
that you bring the water -line up to code (at your expense) and, in conjunction therewith, obtain approval
from the City of Edmonds. Additionally, it will be necessary for you to obtain an casement across the
Property for the water -line (also at your expense).
Time is of the essence. The improper placement of the water -line is delaying the closing of the sale
of the Property. Unless this matter is resolved immediately, you will be responsible for any and all costs
incurred due to the improper placement of the water -line and the resulting delay of Westar's closing.
Further, absent immediate resolution, Westar will be left with no alternative other than to disconnect the
water -line, and remove the water -line from the Property. Thank you for your immediate attention to this
matter.

Long-term stability of the road remains in question due to improper excavation of the adjacent building

site. In her letter of September 14, 2004, Jeanine Graf included a technical memorandum from Landau

Homeowners Association President, Westar was ordered to:

measures and monitoring."

Several homeowners observed continued sloughing of the middle and upper portions of the bank
undermining the edge of the roadway. I contacted the City Building Department in late November to
again express my concerns regarding the continued erosion of the slope, requesting an inspection prior to
commencement of work on the retaining wall while the bank was still exposed. During the week of
December 6, pallets of landscaping blocks were delivered to the site and work on the wall began during
the week of December 13. In my absence, my wife contacted the City again and an inspector was
dispatched to the site. In his letter dated December 17 2004, Mr. Lyle Chrisman wrote that the
inspector looked at the site and reported there was no undermining and the contractor was in the process

This is in response to your letter dated September 13, 2004, Denise and Ricardo
Schwedhelm's letter dated September 12, 2004, and Padmaja Vrudhula ' 's e-mail dated
September 12, 2004, all expressing concerns regarding the private development project at
18019 69"' Place West.
The City has investigated the concerns expressed in the above correspondence and taken
the following actions:
9 Issued a Correction Notice to Westar Construction, the builder of the project at
18019 691h Place West, directing them to do the following:
o Remove the dirt that is covering the water meters.
o Properly and completely cover the stockpiled dirt on the site with plastic
sheeting and anchor the plastic sheeting in place. 91h
o Support and protect the exposed water service line (that serves 18021 6
Place West), and repair or replace the water service line per City
standards.
0 issued an Order to Correct Violation to Westar directing the following actions:
o Immediately install lighted barricades along the access driveway serving
18015, 18017, and 18021 69'h Place West.
o Obtain the services of a licensed geotecl-mical engineer to perforrn a
detailed site investigation and submit a plan that includes temporary and
pen-nanent erosion control and slope protection measures and monitoring.
o Immediately perfonn any work deemed emergency by the geotechnical
engineer.

Dear Mr. Vrudhula:
The purpose of this letter is to inform you that in response to a citizen's complaint oil a possible slope
failure and dangerous condition to a private driveway located to the north of Lot 17 at 18019 69"' Place
West, City officials and City Geotechnical consultants conducted a site inspection oil September 13, 2004
and observed over excavation of the building lot in question exposing a near vertical cut slope oil the
north side of the property and tile sloughing of materials beneath the shared driveway pavement.
Please note that the prin-lary purpose of the investigation was to determine if the cut slope and material
sloughing created an impact to the adjacent driveway. Please refer to the attached Landau Associates
technical memorandum discussing this matter. It is the opinion of the City's geotechnical engineer that
the excavation is overly steep, threatens the adjacent shared driveway and that vehicle traffic should
immediately be limited frorn access on tile southerly 6 feet of the driveway pending.a geotechnical
evaluation by the developer's geotechnical engineer. Therefore, pursuant to Uniform Building Code
Section 3307, entitled Excavation and Grading, as Building Official for tile City, I have officially ordered
the developer (Westar Development Company, Inc) that the southerly 6 feet of tile access driveway shall
be immediately barricaded from vehicle use and access pending further geotechnical investigation.
Furthermore, as a joint property owner of the access driveway you are ordered not to use this portion of
driveway as it may be susceptible to further failure until repaired under tile direction and supervision of
the property owner's licensed geotechnical engineer. The City understands that reducing tile width of the
driveway is a temporary inconvenience however, tile City must take prudent action to safeguard public
safety. The requirements of the Building Official as noted in this letter are appealable within 14 calendar
days to the City Hearing Examiner by filing a formal written appeal and filing fee of $230.00 pursuant to
ECDC 20.105.0 1 OA.

2005) regarding the subject driveway. Upon receipt of your letter, City representatives
visited the site and confirmed that additional requirements will be placed upon the
developer until the City can approve the final construction of the driveway retaining wall.
Be assured, all required permits shall be obtained and all required inspections, including
required special inspections, shall be perfon-ned in order for the City to approve the work.

Dear Mr. Ramni:
The purpose of this letter is to inform you that in response to a citizen's complaint on a possible slope
failure and dangerous condition to a private driveway located to the north of Lot 17 at 18019 69'1' Place
West, City officials and City Geoteclinical consultants conducted a site inspection on September 13, 2004
and observed over excavation of the building lot in question exposing a near vertical cut slope on the
north side of the property and the sloughing of materials beneath the shared driveway pavement.
Please note that the primary purpose of the investigation was to determine if the cut slope and material
sloughing created an impact to the adjacent driveway. Please refer to the attached Lanuau Associates
technical memorandurn discussing this matter. It is the opinion of the City's geotechnicat engineer that
the excavation is overly steep, threatens the adjacent shared driveway and that vehicle traffic should
immediately be limited from access on the southerly 6 feet of the driveway pending a geoteclinical
evaluation by the developer's geotechnical. engineer. Therefore, pursuant to Uniform Building Code
Section 3307, entitled Excavation and Grading, as Building Official for the City, I have officially ordered
the developer (Westar Development Company, Inc) that the southerly 6 feet of the access driveway shall
be immediately barricaded from vehicle use and access pending further geotechnical investigation.
Furthermore, as a joint property owner of the access driveway you are ordered not to use this portion of
driveway as it may be susceptible to further failure until repaired under the direction and supervision of
the property owner's licensed geotechnical engineer. The City understands that reducing the width of the
driveway is a temporary inconvenience however, the City must take prudent action to safeguard public
safety. The requirements of the Building Official as noted in this letter are appealable within 14 calendar
days to the City Hearing Examiner by filing a formal written appeal and filing fee of $230.00 pursuant to
ECDC 20.105.0 1 OA.

Dear Mr. Bowman,
The Estates at Olympic View Crest Homeowners Association wishes to express
er
several concems regarding the construction of lot 17. There appears to be sev al
issues that are not in compliance with erosion control measures and safety standards.
The private road has been undermined due to a 10 — 12 foot deep cut along the edge
of it. There appears to be a loss of the road base. The plywood safety barrier that
was constructed was ineffective in that it blew into the lot sometime during the night
of September I O'h. Larry Seitz was notified the following day, via fax, that this had
occurred. So far, there has been no effort to rectify the problem.
The Association is concerned about the long term stability of the road. We request
that corrective measures be implemented to restore the integrity of the road base. We
also request that a maintenance bond naming the homeowners association as
additional insured be posted by Westar . Development for any future maintenance or
repair of the road, should additional settlement or deterioration of the private road
occur along the edge of property line.
Another area of concern is the exposed soil, There appears to be a lack of proper
erosion control in these areas.
Finally, the existing water line that serves the lower lot 18 has already been damaged
during the excavation, leaving the homeowner with soil in the water and a risk of
contamination. The locate wires have been broken and the line is lying on the
ground resulting in the potential for additional damage during subsequent
construction activities. The water line must be adequately supported to prevent any
future damage and needs to be subsequently backfilled with sand or pea gravel
during the backfill process to prevent any future damage to this service. Also, the
locate wires need to be repaired along the length ofthis water line. It appears as if
