On January 1 11h , 2006 and again on January 24 1h , 2006 1 spoke with A.D. Shapiro concerning the
expiration of permit #2004-0788, and told him of the requirement for a new application and new
fees in the amount of $900.50. As of yet the City has not received the required application or
fees. Please provide a new application form signed by the property owner and fees due ill the
amount of $900.50 on or before 2/17/2006 in order to avoid any code enforcement action.

Dear Mr. McAbcry:
The City is ready to issue the building permit for interior remodeling performed without a pen -nit
in various units at the subject retirement apartments. The pcn-nit, when issued, will include work
to correct code deficiencies created by prior building owners. Although we understand your
position that work is most easily performed when rooms are vacant, because code violations
exist, I shall require that all construction work (including deferred submittals listed on the
approved plans) be complete within 180 days from the date of this letter. As current owner of
the property it is your responsibility to resolve building code violations in this building in a
timely manner which cannot rely on vacancies. The City understands that this may be of
inconvenience to your tenants. Failure to comply with this construction deadline shall result in
issuance of an Order to Correct Violation Notice the first step in the City's civil penalties process
whereby fines are imposed and occupancy is jeopardized until compliance to the codes is
secured.
The City shall continue to allow occupancy of the building but the fire watch must remain in
effect as required by the City Fire Department, and the contractor must coordinate with the Fire
Inspector at any time exiting is reduced or temporarily blocked at any tirne during construction.
Lastly, I am copying the State Department of Labor & Industries Electrical Division so that their
office will be inforined ofthe permit status and work completion deadline.

Mr. McAbery,
The recent discovery of building code violations at the Avalon Inn has resulted in the
additional discovery that the structure is out of compliance with land use regulations of
the Edmonds Community Development Code (ECDC). Current use of the site as a
retirement home is a permitted use, however not at the density that the Avalon Inn has
been altered to contain. The current structure has more units than are allowed for the site
and not enough parking spaces as required by the ECDC. The pertinent issues are:

e Sometime after 2000, 11 additional units were created by splitting some of the
original 36 units with interior walls. Permits were required for this' -work but were
not obtained.
e The structure has 10 more units than are allowed and if permitted, the added units
will require additional parking stalls based on the current use as a retirement
home.
Three solutions are possible in this circumstance that may permit continued elderly
housing at the site. First however, the definition of the use at the site must be clarified.
The use is unclear to the City at this time because the City does not know all the services
you provide your residents. Clarification of the use will determine which options below
are available to you. This definition of use question is basically whether the Avalon Inn
is a retirement home, convalescent home, nursing home, etc. The City considers
retirement homes to be similar to senior apartments. As additional services are provided
by the facility to meet the escalating needs of the tenants the City considers the facility to
be more of a convalescent or nursing home.
These different elderly housing types provide varying levels of service to clientele with
different needs and levels of mobility, thereby affecting the density, parking and other
land'use and building code requirements for the structure. For practical purposes, multi-
family residential standards are applied to structures and uses with apartment -like

features. The more the tenants are required to rely on the facility for meeting their basic
needs, because for example they don't have kitchens in their rooms, the more likely it is
that greater density may be allowed. However, it would come at the expense of a more
rigorous land use permit process.
The three options are summarized below. The first one would require removal of 10
existing dwelling units. The second and third options may permit the existing number of
dwelling units and parking stalls contingent on approval of a Conditional Use Permit.
1) Continuation of the present use of the site as a retirement home (senior
apartments). Density requirements for the site limit the number of units to
37 total dwelling units, therefore this option would require the removal of
10 dwelling units from the site. Current parking regulations would require
1.5 new parking spaces (for the one 'new' unit), pursuant to the multi-
family residential parking requirements found in ECDC 17.50.020.
2) Pursue a Conditional Use Permit for housing for the low income elderly
per ECDC 20.25. This permit may allow for reductions of density and
parking requirements but the project must meet and maintain specific
standards to be eligible, and the reasons for the reductions must be
justified before the Hearing Examiner.
3) Pursue a Conditional Use Permit designating the use as a convalescent or
rest home, pursuant to ECDC . 16.30.010 C 3. This permit may allow for
increased densiiy and reduced*p'arking requirements but the reasons for the
reductions must be justified before the Hearing Examiner.
The Planning Department realizes that you may not be at fault for creating this illegal
condition at the Avalon Inn. You have indicated that you purchased the structure in this
condition and were unaware of the illegal additions that had been made. As the current
owner however, it is your responsibility to take corrective action to remedy the problems
with this structure. It is our intention to assist you as best as we can to bring this structure
and use into compliance, however you must take the initiative, starting with providing us
with a clear description of the use of the site and a plan to bring the building into
compliance.

Dear Mr. McAbery:
I appreciate your prompt compliance last Friday with the dedicated fire watch
requirement.
At the request of the Building Department and with information from recent inspections, I
am treating your building as impaired for use in those designated areas that have been
newly constructed since originally accepted by Snohomish County Planning and
Development Services in 1987(?). The building was annexed to the City in 1997.
The Fire Department will not require vacation of your residents as long as reports are
ards compliance, and meeting Building Division

and common areas, just as the system had been accepted in 1987. Likewise, for the

as I would for any,,stop work" condition. Your fire watch must remain in place until that
time when the residents have been relocated from the new construction areas.
Regarding compliance criteria, Fire and Building Divisions have yet to fully evaluate the
conditions of your building and business. Mr. Shapiro has asked for, and been
approved by the Building Official, for an additional day to submit as -built plans.
Only with those plans and other information can the City completely evaluate the exact
requirements for your business and any deficiencies of its use for the sum of
requirements to compliance. At this conjuncture, I strongly consider that a residential
sprinkler system will be included with those requirements given the nature of Avalon Inn
residents, their activities, their abilities, and the building use.

Thank you for your cooperation in scheduling for an inspection today for the purpose of
determining whether interior remodeling in various units at the subject retirement apartments has
occurred without the required building permit(s). Although we understand your position that the
installation of existing non -bearing walls between units was performed prior to your ownership
of the property, a check of both City and County permit records did not reveal a building permit
for this work. Since the City has obtained a copy of the original plans from the County it is
apparent that additional walls have been constructed between the original two bedroom units
thus creating two individual one bedroom dwelling units.
Unfortunately, as current owner of the property it is your responsibility to resolve building code
violations in this building, regardless of who created the violation. If, of course you or the
previous owner have permits that indicate the work was pennitted please provide copies to the
City for review.
As noted in the correction notice left by the City Inspector today, you are required to submit for
the required remodeling permit within 14 days date of this letter —deadline April 6th, 2004. At a
minimum the City shall require an as -built floor plan showing each altered room or area with
specific notation as to which doors were changed out or replaced. (Note, State law requires that
the plans be prepared and stamped by a State Licensed Architect or Engineer.) Our preliminary
field review indicates that several fire rated doors were replaced with non -rated doors which is a
serious building code violation that jeopardizes the approved exiting and occupancy of the
building. Therefore, no extensions shall be granted to this April 6 1h deadline.
Upon receipt of your application materials, permit application and fees the City shall process the
permit in a timely manner. Once the permit is issued you shall be required to make all required
code changes within 30 days. Be advised, the City shall require inspection of all remaining units
to verify that room layout does not deviate from the original approved plans.

Please be advised, our Building Inspector noted a potential cross connection violation located in
the first floorjanitors closet. Please call our inspector Michael Snook at 425-771-0220 extension
1333 to discuss in detail the remedy to this situation.
Lastly, I am copying the State Department of Labor & Industries Electrical Division who
oversees electrical permits issued within City limits because the walls between the units have
electrical outlets and a permit may have been required for this work.
If you have other information that is pertinent to this matter please provide such information to
my office as soon as possible. If you wish to meet in person please call in advance for a
mutually agreeable day and time. Note, I will be out of the office March 24h and 25th. Lastly,
failure to respond to the correction notice shall result in the start of the City's Civil Penalties
process whereby compliance to the codes shall be secured.
