One is an interior remodel, basically moving a bathroom, and the other is to replace an existing deck with a new and larger one. It is my understanding that you interpret the requirements for ADA compliance. There are two issues which our plan raises that I am asking you to consider. 1. For the interior bathroom move, we ' are being asked to replace an existing exterior 32" door with a 36" door. The interior remodel does not in anyway involve new, or a change to exiting, access to the office. In 1996, we purchased this property and converted it to commercial use. At that time, we met all of the 4 ADA stipulations, one of which was to build a handicapped ramp to the exterior 32" door. In the eight years we have been in this office, we have only had one person in a wheelchair come in, and he was able to make it through the 32" door. Because of the multiple additions to this home over its 100+. years, and the rather peculiar height of the door, that door has to be replaced with a custom door. The estimate for the door and its installation is close to $1,000. Will you allow us to retain the current door? 2. The second item is again a handicapped access issue, this time to the rear deck. The plans give you a basic understanding of the situation. Please allow me to elaborate. There is approximately a 42" height difference between the deck, which is being built on grade, and the existing handicapped ramp from which the stair to the deck will come. The purpose of the deck is two fold. First, we want to make the back yard more pleasant and secondly we want to do it in a fashion that doesn't require weekly maintenance, like a lawn would. In addition, the stairs that provide access to the rear yard are beginning to decay, so for safety purposes they need to be replaced. In order to do so, we would have to remove an existing laurel, cherry, lilac and other smaller plants. The ramp could run parallel to Durbin Dr. and would basically cover the entire existing garden area. There is however barrier free access to the rear yard. This would involve leaving the office across the ramp and heading down the sidewalk to the alley, and then along the alley for about 20' (the length of the garage) and then across the parking area, (the width of the garage) to the deck. I support the intent of the ADA, but in this case, the construction of the ramp would not be in anyone's best interest. First of all, it would require the removal of existing mature landscaping. Second, it would eliminate all privacy for the back yard. The yard runs parallel to the library parking lot. Third, the cost of the ramp is estimated at about $2,500, this is almost 60% of the entire deck project. And finally, the ramp would be of little benefit. I cannot perceive of case in which a wheel chair bound person needing access to that deck. If the situation did arise, the existing access is available and if needed, one of the other employees could provide assistance. As you can imagine, we are novices at the permitting process. Our goal is to fully comply with all of the applicable building codes. But I believe that the ADA does give some latitude for interpretation and appropriateness of the prescribed remedy. So you can get a fuller understating of the project, I've enclosed a CD with several photos. I hope that these will help you to see the existing plantings and backyard.
