We have been involved in the development of your project for many years. We have issued a letter
addressing the planned landscaping to the west of the residence "new garden area", dated May 23, 2003, a
letter providing our geotechnical opinions about the steep slope and the risk -reduction benefits of the

planned tree pruning, dated July 8, 2003, and a letter addressing City of Edmonds comments regarding
grading activities at the site along with providing geotechnical recommendations for the project, dated

Site Conditions
We arrived at the site on January 5, 2005, to evaluate the existing conditions. We observed the following
conditions:

Many of the trees to the west and northwest of the "new garden area" have been pruned, topped,
or cut. The stumps, along with the surrounding underbrush, have been left in place. We did not
observe significant disturbance to the steep slopes.
The area to the west of the garden has been landscaped with grass sod and shrubs. The shrubs
have been placed along a low berm that directs surface water away from the top of the slope.

existing residence is now landscaped with a low block wall, grass and shrubs. A low berm has
also been placed in this area to direct surface water away from the top of the slope.
> A shallow trench has been excavated at the northwest comer of the existing driveway with a PVC
pipe placed along the bottom, presumably to redirect the drainage system of the garden area to the
private stormwater handling system. This trench lies between the garden and the residence and
should not impact the steep slopes or create an erosion hazard. We understand the trench was left
open for the City to inspect. They performed that inspection the morning of January 5"' and the
trench was backfilled later that afternoon.
CONCLUSIONS AND RECOMMENDATIONS
Based on our observations, it is our opinion that the final landscaping for the garden has been completed
in general accordance with our recommendations.
From a geotechnical standpoint, the pruning, topping or cutting of the trees located on the steep slope has
reduced the slope stability risk posed by falling or leaning trees. The mulch, limbs, and underbrush left in

RE: Notice of Repair —Appendix Section 3307 of the 1997 Uniform Building Code
Dear Ms. Clay and Mr. Kerr:
Pursuant to Section 3307 — Hazards, of Appendix Chapter 33, entitled Excavation and Grading,
of the 1997 edition of the Uniform Building Code (LJBC), you are hereby officially notified of
the determination of the building official that the top of slope immediately adjacel.it (west) of
your driveway or in the disputed 25 foot strip immediately west of your property line, addressed
as 7316 164th Street Southwest, Edmonds, Washington, (legally described as Lot 64a;nd 68, Plat
of Meadowdale Beach) is determined to be a hazard and potentially endangers the property of
down -slope property owners and a portion of the City's storm drainage system, due to the illegal'.
excavation and installation of concrete planter boxes and an irrigation system. Although there is
no imminent hazard the potential exists for a dangerous condition due to the location and weight
of structures immediately adjacent to an extremely steep slope.
This determination is based upon a site visit and inspection conducted on May 7, 2003-by myself
and Mr. Steven Wright, a geotechnical consultant to the City of Edmonds from the firrn of
Landau & Associates. Pursuant to our observations, I hereby determine the top of slope and
embankment to be currently a hazard and in need of site remediation back to original pre -
construction conditions. Enclosed is a STOP WORK Order posted yesterday at the property to
cease and desist further construction work (excavation, fill, planters and irrigation system) in this
area.
Pursuant to my authority as building official under UBC Appendix Chapter 33, you are hereby
directed to:
1. Engage a licensed geotechnical engineer who will inspect the site and provide you
with a report and plan for temporary and permanent slope protection and slope mitigation. This
plan will address the need for temporary and pen-nanent erosion control, slope protection
measures, surface and subsurface drainage and improvements along with any other mitigation
measures suggested by your geotechnical consultant. This report shall be submitted to the City
on or before 5:00p.m., May 23rd, 2003. This directive does not relieve you of any separate civil
obligation to stabilize the slope on a temporary and immediate basis.

2. Any work deemed an emergency by your geotechnical engineer in the report shall be
immediately installed or implemented. Nothing in this letter should be interpreted as waiving
requirements for City permits or discretionary approvals. You should consult the Edmonds
Planning Division, (Mr. Rob Chave, contact person), to detennine what discretionary permits, if
any, are required due to the work in a designated critical area. Please contact the City
Engineering Development Manager, Mr. Lyle Chrisman, regarding any potential damage to the'
adjacent City storm system or easement area including all adjacent City right-of-way. For
building permit information I will be your contact person. A den olition permit shall be
required for removal of the illegal concrete planters/footings and irrigation system; the
demolition permit shall not be issued until a written plan of remediation from your geotechnical
engineer is received, reviewed and approved by the City. With the demolition permit
application, a site plan (stamped by a licensed land surveyor), is required to locate the concrete.

restore the excavated area back to original condition. Note, violation compliance fees shall be
assessed to every required permit application.
3. Upon City concurrence with the geotechnical report, move promptly to restore the
slope to original pre -construction conditions. Permanent improvements (concrete planter boxes,
concrete footings, piping system and water irrigation systems) shall be removed under the
direction of your geotechnical engineer. Fill material, placement, grading and re -vegetation
shall also be under the direction of your geotechnical engineer. Report recommendations should
consider the stability of the top of slope and weather conditions when establishing a time
schedule for remanding th6 area back to original condition. Note'this timetable is also subject to
my approval. Once all remediation is complete a final site report shall be provided by the
engineer of record stating that completed work is in conformance with the report
recommendations.
The purpose of this letter is to trigger your obligations under Washington state law, the state
building code and Edmonds City Ordinance #2661. Therefore, failure to comply with the terms
of these requirements, as modified in the future to incorporate your geotechnical engineer's
recommendations, could result in civil or criminal liability. In order to assure compliance I have
also issued, in conjunction with this directive, an Order to Correct Violation Notice, the first step
in the City's Civil Penalties process. Failure to comply with this Order shall result in the
issuance of a Notice of Civil Violation Notice whereby fines of $100-00 per day shall be
assessed. I trust that you will move promptly to correct the problems and enforcement measures
will not be necessary.

mi!pped Meadowdale Landslide Hazard area without first obtaining City discretionga permit approvals
and a grading permit, and 2) Construction of concrete planter structures without Cily approval and a
building permit, and 3) Installation of an irrigation sy�tem without City approval and a permit.
Corrective Action Required: 1) Provide a geotechnical engineer's report and plan for temporM and
permanent slope protection and slope mitigation to include temporM and permanent erosion control,
slope protection measures and subsurface drainage and other mitigation measures, and 2) Perfonn an
work deemed emergency by the:geotechnical engineer by first contacting the designated Ci!y staff for
other associated discretionM Mrmits or approvals, and 3) Submit a complete demolition penni
gpplication to remove all illegal concrete planter structures, concrete footings and irrigation -and pinin
systems, and 4) Submit a complete ff—ading permit Uplication (including a re -vegetation plan) to restore
the excavated area back to original pre -construction condition.
Correction is Required no later than: 5:00pm (time) May 23, 2003 —(date)
If correction is not made by the date and time specified in the Order, a Notice of
Civil Violation shall be issued. The Notice of Civil Violation shall assess fines of
$100.00 per day, or portion of a day, during which the violation continues.
