GEBERT, PE 0 M co: City Engineer M 01 z x Z' 0) z rri c: permit file street file Incorporated August 11, 1890 MEMORANDUM Date: December 17, 2004 To: Duane Bowman, Development Service Director ent U'rec'or Z' 0 ager e rv'ce Via: Rob Chave, Planning Manager From: Dave Gebert, City Engineer .r/ Subject: Sidewalk Construction Wa er for 509 9" Ave N er for 509 Ave N 0 X C M M 0 The City has received a request from Eric Thuesen for a waiver from sidewalk 0 C 09 91h construction requirements at 5 Ave N, in the letter dated November 12, X M M Z 2004. This request pertains specifically to construction of sidewalks on the 10 property frontage along 8 th Ave N. The requirement to construct sidewalks has been reviewed in compliance with.the Edmonds Community Development Code (ECDC) and the 2002 Transportation Element as well as in the benefit to the City 0 of Edmonds. M M Pursuant to ECDC 18.90-030, Table of Sidewalk Standards, RS-1 2 zoning .0 09 9th (which 5 Ave N is) does not require sidewalks, except as shown in the 0 M Comprehensive Sidewalk Plan. It is, however, stated to be City poli cy that C Cn C CD sidewalks will be required on all streets over 300 feet in length (which 8 th Ave N M 0 Z is). X Neither the.City Walkway Plan nor the Bikeway Comprehensive Plan indicate. > proposed projects at this location. Z th The proposed development is within 1,000 feet of existing sidewalks on 8 Ave ca th N.. However, portions of 8 Av& N have been vacated between the subject Z 0 th property and the closest sidewalks on 8 Ave N. Therefore, any sidewalks constructed at the property would be isolated from and not connected to any M other sidewalks on 8t' Ave N. This project is within close proximity (within 1000 feet) and on a street leading to a public park/playfield. City of Edmonds - W1W Community Services Department Engineering Division Mr. Th . uesen argues that construction of sidewalks would be economically unfeasible.due to special topographic circumstances (i.e. grades, existing soils, 20 feet of existing fill). After visiting the site, I do, not agree that it is economically unfeasible or physically impossible to construct sidewalks. However, I do agree that it would be costly. In addition, I do not believe it is in the best interest of the City for the following reasons: 1. The property fronting on 8 th Ave N has a wetland very close to the 8 th Ave z N right-of-way. Construction of sidewalks would require construction very O M close to and possibly encroachment into the wetland. This is not desired bx the City. :q ::H 2. 8 Ave N at this location is a short stretch of a very small, quiet, low traffic th th X road, isolated from the rest of 8 Ave N by vacated 8 Ave N right-of-way. a M C th M 0 3. 8 Ave N at this location is only accessible via Daley Street. This portion 0 0 of Daley Street has difficult topographic features. (creek with steep banks) 0 C that would make sidewalk construction on Daley Street very costly and it M Is highly unlikely that the City will build sidewalks at this location on Daley M Z 10 street anytime in the foreseeable future. Therefore, it is highly unlikely that a sidewalk constructed at the subject property would ever connect to other City sidewalks. 4. Sidewalk construction is clearly not consistent with the character of the n surrounding neighborhood. -1 . . M M While some of the criteria outlined in the 2002 Transportation Element would 0 CO) 0 r 0 require sidewalks to be constructed at the project location, it has been M C Cn CD determined that it would not be in the City's best interest to install a sidewalk at J rn 0 this location. Z Therefore, it is recommended that the City waive the sidewalk construction policy ment and not require construction of sidewalks along the frontage of the 3: require 9th th > z property at 509 Ave N, where it fronts along 8 Ave N, as a condition of building permit approval. Cn z A OVED: 0 M x/ bruane Bowman Date Development Services Director Nov 12, 2004 Eric Thuesen Custom Homes 18333 83th Pl. W. Edmonds, Wa. 98026 Mr. Gebert Engineer City of Edmonds O. Re: Plan check 04-476 Mr. Geb.ert: I am requesting a waiver for a sidewalk at 509 8th Ave. W. The site, meets thezondtions outlined In (ECDC 18.00.040) policy 3.2. b. Special topogaphical circumstances exist within the M right of way that make the contruction of the sidewalk economically unfeasible. The grades and m existing soils, 20ft of existing fill and a grade change of up to 5 ft. make construction both difficult and future settlement a strong possibility. C, K' The nearest sidewalk that would be contigous to this one is on 6th and Daley. There is no ft m z access to this proposed sidewalk from Aloha.
