I have reviewed your request to defer hard surfacing of your parking lot at the Monogram Lumber
building at 22800 - 76th Ave. W. #A.
As I understand the situation, the Building Division is requiring a hard -surfaced handicap accessible
stall in addition to seven (7) other parking stalls. Because the Planning Division does not consider this
to be a change of use, which would require Architectural Design Board approval, I will authorize
continued usage of the existing gravel lot subject to the following conditions.
This authorization is approved until any of the following conditions occur: 1) you apply to. the
Architectural Design Board for approval of a sign, 2) you apply to the Building Division for a tenant
improvement or othertsuch substantial change to the property or 3) you continue to operate the
business after September 1, 1996. This authorization also requires that you immediately coordinate
with Gordy Hyde, Engineering Coordinator, to design the required parking to conform to the existing
City of Edmonds Development Code.
You need to be aware that future surfacing of the parking lot may require that you address water
quality and storm water quantity issues.

Dear Mr. Bowen:
This letter is to inform you that we have received a formal complaint regarding the hydraulic
lift/scaffolding with furniture on top with hand made signs and banners along with other banners posted
at various places at 22800 76th Avenue W. A site inspection was conducted which found several
violations of the sign code.
The scaffolding with furniture and hand -lettered cards and banners is a violation of Edmonds
Community Development Code (ECDC) Section 20.60.0 10 which requires a permit to be obtained for
any sign, defined as a display visible from a public place that is intended to convey a message to the
public and/or attract attention to the goods and/or services provided by an enterprise. The scaffolding
display would be considered a freestanding sign, which is required to be approved by the Architectural
Design Board as part of the process to obtain a sign permit. The City has a policy of discouraging
freestanding signs, so you would have to demonstrate that no reasonable alternative exists to satisfy the
identification needs of your business. In the CG zone in which you are located, the allowable sign area is
governed by ECDC 20.60.040.C, with general regulations on height, placement, et cetera, in ECDC
20.60.040. Wall mounted signs for general commercial establishments are regulated in ECDC
20.60.045.
The site also has banners which are over the allowable sign area of 10 square feet and are being used
continually to advertise, which is in violation of Section 20.60.090 of the Edmonds Community
Development Code. For your information, should you wish to post temporary banners in the future,
below are the ordinance requirements regarding temporary signs.
TEMIPORARY SIGNS
A temporary sign is one which is not permanently attached to the site and advertises an event that is
occurring or will occur, or a product or service that is available for a short, limited period of time.
General Regulations: Temporary signs are not allowed to continually advertise goods, services or
events on a site (permanent signs shall be used for that purpose). Unless specified in the table below, no

This letter is regarding the temporary signs at 22800 - 76th Avenue W for Best Buy Furniture. I
had written a letter to you on May 6, 1996, stating that we wanted to see the sign erected within
one month of the Architectural Design Board's decision. The Architectural Design Board made
its decision to approve the permanent sign design on May 15, 1996.
After speaking with both you and Mr. Michlitch on June 13, 1996, 1 understand that Mr.
Mic'hlitch is working on financing of the sign and is in the process of selling some property to
pay for the sign. In order to provide some time for these transactions, we are extending the
deadline to erect the sign until July 31, 1996. Note that signs are structures which require a
building permit. If a complete building permit application has been submitted prior to July 19,
1996, and a sign company is under contract to erect the sign, we could work with you to. adjust
the deadline to fit the sign company's schedule.

Dear Mr. and Mrs. Michlitch:
During a recent site visit to the above site, I discovered that several signs had -been erected for
Best Buy Purniture without A building permit and some without Architectural Design Board
approval.
The Architectural Design Board approved a 6 foot by 14 foot sign along Highway 99 at their
May 15, 1996,meeting, However, the sign already extended to the maximum height limit for a
sign, so the small rocking chair sign above it exceeds the allowable height, and was not approved
by the Architectural Design Board (ADB). Also the sign on 76th Avenue W was only shown as
a temporary sign, and according to the notes of the May 15, 1996 ADB meeting the temporary
signs were going to be taken down when the permanent sign was erected. A banner on the
building on 76th Avenue W exceeds the size limit for temporary signs, and appears to have been
on the building longer than the allowed one month time limit. Also, building permits are
required for new sign installations and a check of building division records indicates that no
pennits have been issued for any of these signs.
We have explained the ordinances in previous letters to you and Mr. B6wen. We appreciate your
obtaining ADB approval. However, to bring your signs into compliance with the code, you will
need to take the following action by September 19, 1996:
I - Remove the small rocking chair sign above the 6 foot by 14 foot sign on Highway
99; and
2. Remove all signs which were not approved by the Architectural Design Board,
including the posted sign on 76th Avenue W and any banners which have been up
longer than one month; and

After speaking with Clark Bowen on October 29, 1996, 1 understood that he was going to bring in the
completed building permit application, so I held the check waiting for the application. -After speaking to
Mr. Bowen on, November 25, 1996, he told me that you would be taking care of the permit application
and additional fees, because you are charging him additional rent since the sign has gone up. Therefore,
I am returning the check to you.
You also had a number of comments and questions in your letter.
1) 1 appreciate you taking down the signs on 76th.Avenue W.
2) 1 understand that the "small rocking chair sign" was placed there to cover some of the
mechanical parts of the sign which were not going to be used. However, the added height was not
mentioned during Architectural Design Board review, or they could have pointed out that the height of
the sign would be measured from ground level to the very top of any structural member of the sign. As
you point out, there is a drop off to the level of the sign, so if the area by the base was regraded so that
the height from the final grade to the top of the "small rocking chair sign" was 25 feet then that would
meet the 25-foot height limit. Since the Architectural Design Board did not review the addition of the

Dear Mr. Michlitch:
The purpose of this letter is to outline all known violations at the property located at 22800 76 1h Avenue
West, Edmonds. In order to create this list I have conferred with City Engineering and Planning staff and
believe I have a complete list of all outstanding items. However, in the course of the permitting process
other issues may be brought to the City's attention and if code violations are noted by staff they cannot be
ignored and must be resolved.
Pole Sign: The existing pole sign near Highway 99 received Architectural Design Board (APB)
approval but the design approved did not include the rocking chair logo. This change is significant
enough to require that you submit a new ADB application (fee $105) and a colorized rendering of the
sign. The rocking chair logo extends above the allowed 25-foot height limit, and would require a
height variance to allow it to remain (variance fee $655). Also, according to City records no sign
permit was obtained for installation of this pole sign, therefore a complete sign permit application
(including double permit fees) shall also be required. Lastly, since the footing was poured without
inspection a licensed professional engineer shall be required to perform an inspection on the existing
sign and provide a letter to the City stating the sign was installed per engineering standards and no
known deficiency exists. Removal of the entire pole sign with a demolition permit (fee $55) is also
an option to resolve this matter.
Building Signage: There is no record of ADB approval or sign permits for any of the signs that are
placed on or near the building. The City Code for signage requires such approval for any sign that
conveys a message of a service or product to a consumer. All such signs must be removed or
separate ADB and sign pen -nit applications must be submitted (double fees shall be assessed).
Banners, Flags, Temporary Signage: Temporary signage is permitted to convey a business opening,
closing or special event. Temporary signs are permitted for a maximum of 60 days in any calendar
year. All existing banners, flags, and other temporary signs on site must be immediately removed.
Storage Rental: Storage is a permitted use in the business zone where your property is located.
However, if you are renting out a portion or portions of buildings for storage, the City Clerk's office
considers this to be a business and you shall be required to obtain a City business license, (fee $65,
application enclosed).

• Canvas Covered Pole Building: According to City records the canvas covered pole buildings have
not received ADB approval or required building pen -nits. These structures must be removed from site
or you must submit complete ADB and building permit applications (double fees shall be assessed).
Be advised, if these buildings do not meet Uniform Building Code provisions for construction they
could only be approved as a temporary building under a Conditional Use Permit (fee $2,155) for one
year with a maximum one year extension. Another way to resolve this matter is to obtain a
demolition permit to remove the structures (fee $55).
• Outdoor Storage: A Conditional Use Pen -nit is required for outdoor storage. The materials in
question include vehicles and construction materials located on the west end of the property. All such
items must either be removed from site or be placed within the existing permitted buildings on site or
you must make complete application for a Conditional Use Permit (fee $2,155).
• North Pole Building: The building located along the north property line appears to have been altered.
City records indicate this was a wood rack system and smaller pole building but now is a much larger
metal pole building with garage doors. The City has no record of ADB approval or building permits
for this remodel work or for new pole building construction. If you have additional information on
this work or building please provide copies of all documentation for our review. If remodeling or a
new building was constructed without City approval you must submit complete applications to the
ADB and for a building permit (double fees shall be assessed). Another way to resolve this matter is
to obtain a demolition permit to remove the structures (fee $55).
• South Building: The building located along the south property line appears to have been re -sided.
The City has no record of ADB approval or building permit for this work. Again if you have
additional information on this building change please provide copies of all documentation for our
review. If the building was re -sided without City approval you must submit complete applications to
the ADB and for a building pen -nit (double fees shall be assessed).
• Barrier Free Parking Space: The City required one on -site barrier free parking space. A site
inspection indicated an existing concrete pad but no required barrier free signage was noted. Please
refer to the enclosed detail. One required barrier free parking space must be provided on site with
appropriate signage.
• Parking Lot: The City shall require that the parking lot be improved to a hard surface as required by
the City Development Code. The City Engineer has detennined that at a minimum all curb cut areas,
parking areas, storage access areas, drive -aisles, turnaround areas, required parking spaces, etc. be
paved. Essentially all graveled areas from the east property line to the west end of all existing
buildings must be improved. Refer to the enclosed site plan showing the minimum areas to be paved.
A complete ADB and building permit application shall be required for this work including civil
engineered plans to address stom-i drainage requirements. Please note that during the ADB review it
is highly likely that landscaping shall be required to be provided on site. Refer to the enclosed ADB
Landscaping handout for more information.
• Required On -Site Parking Spaces: In order for the City to determine the minimum number of
required on -site parking spaces you must provide a breakdown that includes the square footage of
building area, the type and square footage of each building use, the number of employees, etc.

Status of Corrective Action: Mr. Mitchlitch in response to the Order to Correct Violation Notice dated
7/10/02, submitted incomi)lete building permit and ADB applications to the City. Numerous
correspondence has been sent notif�dng him of outstanding Planning, Building, and Engineering
requirements and a final deadline of FebruM 7, 2003 was established but Mr. Mitchlitich failed to meet
this deadline.
Corrective Action Required: 1) Remove all illegal work that has not received Architectural Design
Board approval or building permits, OR, 2) Submit all outstanding information in order for the buildin
permit applications to be deemed complete. Once complete, the Citv can continue the review of the
applications and issue the approvals and permits.
The person(s) to whom this Notice is issued is being assessed $100.00 per day, or portion of a day, during
which the violation continues. Note, once civil penalty fines are imposed they may only be waived,
suspended or reduced by the Hearing Examiner during the appeal process.
If correction is not made by 5:00pm (time) March 7, 2002 (date) an
abatement notice may be issued warning of impending City abatement of the violation. Any and all costs,
including incidental costs, will be added to the monetary penalties assessed against the person to whom the
Notice is issued.
The imposed monetary penalties are immediately payable to the City of Edmonds at City Hall located at
121 5th Avenue North, Edmonds, WA 98020.
This decision is appealable to the City of Edmonds Hearing Examiner by filing a written notice of appeal

In response to your letter dated 11/27/03, addressed to the City Assistant Building Official, I have the
following information:
If it is your intent to terminate your application(s) for building permits for the subject property, then as
Building Official for the City I shall require that you immediately obtain demolition permits and
remand each building back to its original pre -remodel condition within 60 days date of this letter.
Demolition permits are $75.00 per building, obtain forms at City Hall. Failure to obtain demolition
pen -nits and complete demolition work by February 2, 2004 shall result in enforcement action. If that
is not your intent refer to the corrective action outlined below.
With regard to your question concerning citizen comments I have directed this to our Planning
Division for response as I am not part of the public hearing process and would have no information on
this issue. With regard to statute of limitations, such statues apply to structures constructed, repaired,
remodeled or improved prior to building or zoning code adoption. In other words, structures
constructed or altered prior to the adoption of City or County codes (whichever entity had jurisdiction
at the time of construction) may be determined to be legal non -conforming. The City has had adopted
building and zoning codes in place since October 1956, since you have admitted that the majority of
the work was performed between 1993 and 1996 statute of limitations in your specific case is a mute
point.
As you may recall, I issued you an Order to Correct Violation Notice on October 27, 2003 for failure
to respond to outstanding Building Division corrections from August 8, 2003. 1 am administerally
extendine this deadline to December 19, 2003 for tile complete resubmittal of all outstanding
building division requirements. Please resubmit to Theresa Umbauggh, the lead Permit Coordinator on
your project. Contact Ann Bullis, Assistant Building Official, if you have any questions about building
code requirements. Failure to submit all required information and details by this deadline shall result
in the issuance of a Notice of Civil Violation whereby fines of $100.00 per day shall be assessed until

Thank you for meeting with City staff last Friday regarding your project. In response to your request, I
have researched City pen -nit records and have discovered the following information (copies of permits
and site plans attached):
Refer to Plot Plan #1 and attached copies of building permits:
o This plot plan shows the original warehouse building located on the southeastern portion of the
property. We were unable to locate a City permit on file for its construction and surmise that it
may have been constructed in the County. This property was annexed into the City in 196 1.
o Building Permit #730103 was issued for a small office addition to the original warehouse
building (I have dotted on the approximate location on the plot plan).
o Building Permit #730568 was issued for a 16' x 60' shed roof addition over a storage area. The
City has no plot plan or plans on file for this work and according to subsequent plot plans for
the property this work appears to have not been done.
o Building Permit #770102 was issued for an 18' x 72' storage shed on the northeast portion of
the property (highlighted on the plot plan). Note, this building received a variance to locate
within 5 feet of the north property line. Because 228"' Street SW is adjacent to your north
property line you are permitted to use half of this right-of-way as the assumed property line for
exterior fire wall and opening protection requirements. Since the plot plan indicates the
building is 5 feet from the property line and half of the right-of-way is 15 feet (for a total of 20
feet), no fire wall is required on the north wall of Building B or C. Refer to the enclosed
covenant regarding future development of 228 1h Street Southwest. If you have any questions
regarding the covenant contact our City Engineering Division.
Refer to Plot Plan #2 and attached building permit:
o Building Permit #780023 was issued for a 24' x 96' shed roof addition to the west of the
original warehouse building on the southwest portion of the property. This building was
granted a variance to locate 7 feet frorn the south property line. From the approved plans on
file with the City, the south wall is a one hour fire wall. The plans also indicate that a parapet
was required on this south wall because it was within 10 feet of the property line. We assume
that the fire wall and parapet were installed in 1978 according to the approved plans.

Based on this historic permit information the following is required by the Building Division in order to
"0' issue the permits for Building A, B and C (refer to Plot Plan #3):
o Building A (western half): The original pole building is considered to be non -conventional
design and because garage doors and siding were added to the north wall of this building and
siding on the west and east sides, a licensed engineer must stamp your plans for lateral load
compliance.
o Building B & C: Revise the plot plan on file to show that the buildings are a minimum of 5
feet from the north property line (also show 228 th St SW as 30 feet of undeveloped City right-
of-way). No fire wall is required on the north wall. No parapet is required on the north wall.
A one hour fire wall is required on the south wall due to the proximity of the original
warehouse building but no parapet is required on the south wall. This building plan must be
stamped by a licensed engineer because it is non -conventional construction and the total area
exceeds 4,000 square feet.
o Building corrections dated August 8, 2003 (copy enclosed) items 1-3, 5-6, 8-9 still apply.
Planning Requirements
During the Friday meeting you mentioned that you may decide to reconfigure Buildings A & B, back
to the original conditions but leave the exposed racks. Exposed racks create an outdoor storage use
and although the City is aware that the lumber yard had exposed racks and outdoor storage in the past,
such use now would be considered non -conforming --because outdoor storage has ceased on the
property for more than six months. A conditional use permit would be required if you intended to have
any outdoor storage. Lastly, City Planner, Kathleen Taylor confinned no landscaping bond will be
required for your project.
.,,*Engineering Requirements
In the meeting you mentioned that the required engineering improvements were very costly which
includes storm drainage and on -site paving. Lyle Chrisman explained that the building improvements
on Building A and B and the new Building C is what is generating the required improvements. Please
refer to the most recent engineering comments dated April 28, 2003 and revise plans accordingly to
meet these requirements. Provide a contractor's bid or engineer's estimate so that the total bond
amount and engineering inspection fee can be calculated. The bond is required in order for the City to
be assured that the required improvements are installed within the permit time limit.

Please contact Steve Fisher, Recycling Coordinator at 425-771-0235 extension 1603 regarding his plan
review comments dated 7/10/03 (copy enclosed) and your specific dumpster situation.
