The applicant for the above site submitted a pen -nit application for Tenent Improvements and part

of the improvement was to restripe the parking lot. Per our current policy on parking lot striping,�

bring the parking stall up to current standards. However, one of the requirements by the Bldg

During my review, I looked at the parking stall layout and although the ECDC requires non

compliance items be brought up to current standards if changes or improvements are made, _T

made the decision to allow the existing parking stall depth to remain. The reason for not

was because the north property line of Herfy's was cl e to the building
requiring the upgrade os
(approximately 12') and we cannot require the applicant to stripe onto the adjacent property.

Recently, the property owner to the north filed a complaint about the parking configuration at

Herf�'s referencing the stalls did not meet current City standards After fu her review of the

drawings and field measurements, we found that the property line of Herfy s was I V north of

said building, the depth of the parking striping was only 10' but the width of the stalls are 9.5'.
With the property line I V from the building, the applicant wo uld have had to encroach 5.5' onto,
the adjacent property to meet current.parking standards and as outlined above, we cannot require
the applicant:to encroach on adjacent property, without mutual concent of the adjacent property

owner. Therefore the previous decision not to require compliance to current standards was
support ed.
In addition, the shared entrance between the two properties is non conforming andfurther

encroachment into that non conforming entrance would have created more safety issues than
