Dear Ms. Wright:
As you are aware, the corrections required for the referenced deck, on the Order to Correct
Violation Notice dated November 14, 2006 (copy enclosed for your convenience) was required
to be completed by December 31, 2006. Unfortunately, a City inspection performed on
December 29, 2006 and again on January 3, 2007 revealed the same outstanding corrections as
first noted in City Correction Notice dated November 9, 2006. It appears no progress has been
j made to the outstanding corrections during this period of time.
! The City is thus forced to issue the Notice of Civil Violation and commence fines of $100.00 per
day against you. Fines are immediately due and payable to the City. In order to resolve the
violation matter the following is required of you:
1. Construct and/or re -construct the deck per the approved plans
2. Provide the City a survey proving setback compliance
3. Re -call the City Building Inspector for inspection when the deck is 100% compliant to
the approved plans
Fines shall accrue at the rate of $100.00 per day until all above noted items are resolved. If fines
reach the amount of $5,000.00 the City shall utilize our collection agency for the re-couping of
Iaccumulated fines. Once your account is forwarded to collections pursuant to State Law fines
are collected at the rate of 150% of fines owed. Furthermore, once an account is sent to
collections the City has no ability to alter the accumulating fines.
It is not the City's intent to cause you undue hardship however compliance to the codes is
mandatory for the fair and equal treatment of all citizens. Your prompt attention is required to
resolve this matter and stop the accumulating fines.

Thank you for your submittal. I have reviewed the above building permit application for the
Planning Division and it was found that the following information, corrections, or clarifications
will need to be addressed before review can continue:
1. Setbacks/Nonconformity: The minimum setbacks for the RS-12 zone are as follows: 25-foot
street (East/OVD), 10-foot side (North and South), and 25-foot rear (West). The existing
deck does not meet either the minimum 10-foot side setback to the south or the minimum 25-
foot rear setback to the west. Because the cost to replace the deck is assumed to be less than
5001. of the replacement cost of the entire building (the house plus the deck) pursuant to
Edmonds Community Development Code § 17.40.020.F, then the deck can be reconstructed
(and the joists replaced) but it cannot increase the nonconformity of the deck. The footprint
of the deck cannot increase. Posts cannot be located within the setback area. Please revise
the project and show how you will construct a new deck in exactly the same footprint as the
existing deck (or smaller, if preferred) and how the posts that will support the new deck will
meet the minimum setback requirements for the RS-12 zone. Please contact either myself or
the Building Division if you have any questions before you resubmit.
