There is no evidence of an approved n l: IN 4 building permit for the deck (Mr. Palmaffy claims it was built around 1990) so the applicant submitted a building permit ` rn application this summer: Under our current code (when the building permit was submittedIN ), a portion of the deck.along the I �" north (rear) needs to be removed in order to meet the minimum 15 -foot rear setback. I began review in August and finally IN o. signed off in December. p i On Monday, Mr. Palmaffy requested we re -review how we would apply setbacks for the property, because he does not m 0 r want to remove any of the deck - he wanted us to try to consider it a "corner lot". After looking into it further (we checked O n Vol with Engineering staff, reviewed the legal description for the short plat's private road, and made a site visit) and have e 1 concluded that setbacks for the application were indeed correctly applied and that the site is not considered a "corner lot Z The following setbacks that 1 reviewed it under in August still apply: -♦ MORRIS f. IN 5 Z :i South "street" setback of 25 -feet. IN rCD- EastNVest "side" setbacks of 7.5 -feet. = F' 3 North "rear" setback of 15 -feet.
