Thank you for your submittal. I have reviewed the above building permit application for the Planning
Division and it was found that the following information, corrections, or clarifications will need to be
addressed before review can continue:
Setbacks (new patio & new walkway):
1. The revision shows that the patio projects into the setback
area. The patio, if uncovered and under thirty inches, may project up to one third or four feet into the
setback, whichever is less (ECDC 16.20.040.C). The minimum street setback requirement is 25 feet.
Please show on the site plan how your proposal meets this requirement – it may project as far as four
feet into the street setback (as close as 21 feet to the street property line). Please revise the site plan
and include the distance so that your project meets this code requirement.

Uncovered and unenclosed porches, steps, patios, and decks may project into a required setback
not more than one-third of the required setback, or four feet, whichever is less; provided, that they
are no more than 30 inches above ground level at any point.
