All structures are required to meet the minimum setbacks for the zone. The minimum setback requirements for your property are as follows: Front Setback (south) Side Setbacks (east/west) Rear Setback (north) 25 feet 7.5 feet 15 feet Also note that accessory structures that are less than 600 square feet in area (like the existing shed shown on the site plan) may be located as close as five feet from the rear property line (but it is still required to meet the minimum 7.5 side setback requirement). It appears that your shed is located too close to the side property line (a five foot setback is shown, where a 7.5 foot setback is required). Also, is the existing deck covered or uncovered – and what is the height of this structure? This deck would also need to meet the minimum 7.5 foot side setback requirement. ECDC chapter 16.20.040.C states, “Uncovered and unenclosed porches, steps, patios, and decks may project into a required setback not more than one-third of the required setback, or four feet, whichever is less; provided, that they are no more than 30 inches above ground level at any point.” If this provision is applicable to the existing deck (if it is uncovered and less than 30 inches in height), then it would be permitted to extend 2.5 feet into the setback (so it could be as close as 5 feet from the side property line).
