In response to your inquiry regarding EHB 1848, the City is only required to retain building enclosure
design documents when building permits for construction or rehabilitative construction (of multi -unit
buildings as defined in the house bill) are required. When permits are required the application trust
include building enclosure design documents and details (prepared and stamped by a Washington State
licensed Architect or Engineer) that identifies the building enclosure construction (i.e., waterproofing,
weather proofing and/or other protection from water or moisture intrusion). Note in the case of multi-
unit buildings under one ownership this requirement may be waived if a recorded irrevocable Sale
Prohibition Covenant is submitted with the application and recorded with the Snohomish County
Auditors office.
The City is prohibited from issuing a permit for construction or rehabilitation/repair construction
unless proper building enclosure documents and details are provided (unless a covenant is provided as
stated above). Rehabilitative construction means construction work on the building enclosure (i.e.,
roofs, exterior wails, decks, windows, exterior doors, vents, etc.) that costs more than 5% of the
assessed value of the building (assessed building value is determined by the Snohomish County
Assessors' records). When the 5% rule applies, required Building Enclosure Design documents and
special inspection are required.
Specifically regarding the multi -unit building at 1115 4th Avenue South in Edmonds, you have
indicated you are the sole owner of the building, you have also provided sufficient evidence that the
building enclosure work performed under building permit #2006-0687 does not exceed the 5%
rehabilitative rifle --therefore EHB 1848 does not apply to this specific project.
If you have opted to voluntarily produce building enclosure documents you can request to the City in
writing that said documents be filed with the referenced building permit but the documents will not be
reviewed nor approved by the City.
