Dear Applicant,
I have reviewed the above building permit application for the Planning Division and it was found that the
following information, corrections, or clarifications will need to be addressed before review can continue:
Height Calculations:
1. Please submit building elevations that show to scale: (1) the Average Grade,
(2) the Maximum Elevation (25’ from the Average Grade), and (3) the Actual Height (measured at
the ridgeline – information submitted suggests this measurement was actually taken from the top of
the joist instead of the very top of the highest ridge).
09/27/06: Please submit building elevations so we can determine if the project will remain under the
25-foot height limit.
10/09/06: Thank you for submitting an elevation view of the proposal. I have another question,
though. The height calculations shown on the site plan give an Average Grade of 90.62. This means
the Maximum Elevation is 115.62. Your elevation shows different figures – please make the site plan
and the elevation calculations consistent. The elevations show the height about ten feet lower than
the max elevation, but the height calculations indicate that the max elevation and the actual elevation
are the same. Please confirm.
Nonconforming Building:
2. Please review Edmonds Community Development Code (ECDC) titles
17.40.020.B and 17.40.020.D (below) regarding nonconforming buildings. The minimum setback
distance from the building to the property line is ten (10) feet; however the site plan shows that the
existing building is closer than this distance to the property lines. Are you increasing the footprint of
the existing building in any way? Are you increasing the height of the existing building in any way?
Please clarify the scope of your project so I can determine if you are simply doing some ordinary
maintenance or if you are increasing the degree of nonconformity (which could not be permitted
without an approved Variance application).
17.40.020.B. Continuation.
A nonconforming building may be maintained and
continued, unless required to be abated elsewhere in this chapter or section, but it may
not be changed or altered in any manner which increases the degree of nonconformity of
the building.

17.40.020.D. Maintenance and Alterations.
1. Ordinary maintenance and repair of a nonconforming building shall be permitted.
2. Alterations which otherwise conform to the provisions of the zoning ordinance, its site
development and bulk standards, and which do not expand any nonconforming aspect of
the building, shall be permitted.
09/27/06: We need to know how much space is being added in the setback area, and this cannot be
habitable space. Jenny Readwin explained at the counter how this can best be demonstrated –
through a detailed elevation drawing that shows the pitch of the roof, the new interior space, and
where this is in relation to the property line. Please draw a detail – we need to see that this proposal
is not increasing the degree of nonconformity.
10/09/06: Please respond – please show a cross-section detail that explains how much area you are
proposing to add into the setback area. Please contact myself or Jenny Readwin if you have
questions on how to demonstrate this to us.
