Dear Applicant,
I have reviewed the above building permit application for the Planning Division and it was found that the
following clarifications will need to be addressed before review can continue:
Guest House/Setbacks:
1. I could not locate permit approval for a guest house, a detached garage, or
any detached accessory building in our system. Please be aware that guest houses are not permitted
on lots under 20,000 square feet, and even then, they require land use approval through a conditional
use permit. Pursuant to Edmonds Community Development Code chapter 21.35.030, “Guest house
means a detached structure with not more than two bedrooms, accessory to a single-family dwelling,
having no kitchen facilities, used primarily for sleeping quarters, not occupied by paying tenants, and
located on a lot of at least 20,000 square feet in area.” It looks like the County Assessor’s data
shows a 400 square foot detached garage but the survey shows a detached building that is over 800
square feet and that does not meet setbacks. This site was annexed into the City on 08/01/1963 and
the house was built in 1963 – if it was built prior to the annexation date, please provide the County
building permit which should show the detached building on the site plan so that I can try to review
this as a nonconforming building. Otherwise, it would need to come into compliance with setbacks
which means that it would need to be at least 25’ from the rear (east) property line, 10’ from the sides
(north/south) and 25’ from the front (west). However, if it is under 600 square feet in area, it may be
located as close as 5’ from the rear property line. Please confirm the area and information on permits
for this structure (does it have a kitchen or a bedroom – it it heated or unheated space?).
