Dear Applicant,
I have reviewed the above building permit application for the Planning Division and it was found that the following
information, corrections, or clarifications will need to be addressed before review can continue:
1. Accessory Dwelling Unit (ADU):
Thank you for submitting a “Statement on ADUs” – however, you wrote in
the margin and the legal description was incomplete. I’m aware that the County has strict recording
requirements. I typed out a fresh clean legal-sized copy for you and have enclosed it in the mail. Please have it
notarized and either (1) take it up to the County Auditor’s Office for recording and return a recorded copy to us
(they will charge a $32 fee), or (2) turn it back in to us and we will record it for you (we will charge a $47 fee).
04/03/07: I didn’t see this with your re-submittal… I’m enclosing another copy for you to sign/notarize and turn
back in (if you want us to process it for you – you are more than welcome to take it up to the county yourself). Let
me know how I can assist.
2. Setbacks:
The minimum street (west) setback in the RS-6 zone is 20 feet. It looks like the second story
addition is proposed at 17’8” from the street property line. I cannot administratively approve a project that does
not meet the minimum setback requirements for the zone. Please either (1) step the second story addition back
further east in order to meet the minimum 20 foot setback, or (2) apply for and obtain a variance to the setback
standards. I have enclosed a handout on the variance process – please note that they are difficult to obtain
because the applicant must prove that they meet ALL of the six variance criteria. Variances take approximately
3-4 months to process, cost approximately $1,320, and there is no guarantee of approval (and no refund). If you
choose to apply for a variance, please contact me so that I can elaborate on the process.
04/03/07: I can’t tell from the site plan that the new second story bay windows remain out of the setback area – is
this something that you could redline for me? I’m certain you are trying to stay out of the setback area, but for
clarity, it would be great to have any projecting modulation shown on the site plan. Let me know how I can assist.
