Dear Applicant,
I have reviewed the above building permit application for the Planning Division and it was found that the
following information, corrections, or clarifications will need to be addressed before review can continue:
Critical Areas Checklist:
1. Please submit a Critical Areas Checklist (enclosed) along with the $135
processing fee at your earliest convenience. Because you intend to alter the footprint of the existing
structure, we need to make a critical areas determination – there is none on file for this site. These
take approximately two weeks to process, however, please let me know as soon as you turn it in and I
will be happy to keep my eyes open for it and to make sure it is completed in a timely manner. But, if
there are any streams, wetlands, or steep slopes apparent on or adjacent to your property, studies may
be required to ensure that proper buffers are maintained. If no critical areas are found on or adjacent
to your property, then you will be issued a “waiver” from critical areas report requirements.
Lot Coverage:
2. Please provide the new building footprint area. Lot coverage includes anything
covered by a roof. If your property is 9001 square feet in area as shown on the site plan, then the
maximum lot coverage will be 3,150 square feet – or 35% of the lot area. Please label the total lot
coverage on the site plan and make sure you do not exceed this figure. For your convenience, here is
the definition of lot coverage, pursuant to ECDC 21.15.110: “Coverage means the total ground
coverage of all buildings or structures on a site measured from the outside of external walls or
supporting members or from a point two and one-half feet in from the outside edge of a cantilevered
roof, whichever covers the greatest area.”
Accessory Dwelling Unit (ADU):
3. It appears that there is an Accessory Dwelling Unit on site,
however there is not an approved ADU permit in the system. ADUs are a permitted secondary use in
single family zones, but first require an approved conditional use permit. There is no such permit in
the system for this site. I have enclosed a handout on ADUs, which summarizes the requirements
found in ECDC Chapter 20.21. Please read through the handout and let me know if you have any
questions. Your options are to either: (1) remove the illegal ADU from the plans (speak with a permit
coordinator about the building permit process to remodel this area) and sign and have the “Statement
on ADUs” recorded at the County (there is a recording fee) or (2) apply for an obtain a conditional
use permit and land use approval for an ADU that meets all of the provisions in chapter 20.21. If you
would like to apply for a conditional use permit, please contact me and I would be happy to walk you
through the process and land use fees involved (a permit coordinator can assist you in determining the
building permit fees for and ADU).

Setbacks:
4. What does the bold dashed line represent on the site plan? The rear east setback is 15 feet
and this line does not appear to meet setbacks. Please show all landings on the site plan, too.

(affected sheets only) with a written response to each of the above items. Please make all submittals to
