Aldridge hereby grant to the CITY OF EDMONDS, a Municipal Corporation, a permanent Easement for the installation, operation, and maintenance of SANITARY SEWERS over, across, through and below the follow- ing described property, and the further right to remove trees, bushes, undergrowth and other obstructions interfering with the location, construction a of said utility or utilities. Installation of the sewer line with subdrain and drainage construction as per the sketch to Dr. Aldridge from Shannon & Wilson dated April 30, 1969, except as revised by the letter to Dr. Aldridge from Shannon & Wilson dated August 26, 1969, and except that asbestos -cement (Transite) pipe shall be used instead of Cast Iron or Concrete. 2. The use only of asbestos -cement (Transite) sewer pipe with rubber gaskets and with proper occluding connections. 3. The sewer trench must be hand -dug with careful protection of all existing trees, shrubs and lawn while the wo rk is in progress. The moving of such trees, shrubs and lawn necessary for the installation of the sewer line must be supervised or undertaken by a Nurseryman. 4. The replacement of all damaged trees, shrubs and lawn for a period of one year after completion of the sewer along the line of the sewer excavation by a Nurseryman. The replacement shrubs or trees to be of the approximate same size and value as those damaged. 5. Thorough clean-up and restoration of the yard after construction to as near original condition as possible, 6. Replacement of bank or (back West) yard lost as the result of excessive sloughing resulting from the placement of the sewer line in this (back West) yard. 7. In the event of a significant sloughing or fall of bank as a result of the sewer construction occurring after the sewer line is installed, the City of Edmonds will be responsible for the erection of a rock wall, concrete retaining wall or L some other permanent type of retaining casement to support the West bank from further deterioration and loss of West frontage. 8. All cleanouts to be placed in inconspicuous areas, preferably not under lawn or trees, where maintenance will not inconvenience the property owners or cause damage to property, trees, shrubs or lawn. 9. The excavation and sewer line may only be placed along the line agreed to by the owner and the surveying engineer, R. Jung, on Saturday, May 10, 1969, or any moderation of this line agreed to specifically by the owner. 10. Careful protection from damage for the concrete retaining wall and wooden fence on the Southwest side of the Lot, and similar protection for the fences on the Northeast side of the Lot. Any damage to these structures to be re- paired without delay by the contractor. 11. Replacement and repair of black -top path after excavation and sewer install- ation is complete. All replaced earth to be properly tamped to prevent further sinking or irregularity of contour over the sewer line. 12. Messrs. Shannon & Wilson to be notified when construction is in progress so that they can inspect the installation of the sewers. V311 f iOA V4 1. 696-A 23 Exhibit "A" (continued) 13. Any settling of lawn or ground along or over sewer line to be corrected promptly by City of Edmonds. In the event of leaking or rupture of sewer lines, immediate repair and restoration of property to be made by the City of Edmonds or under the supervision of City of Edmonds at the expense of the City of Edmonds. 14. This easement as described herein is contingent upon protection against pollution of beach and lot which may arise out of sewer installation excluding Acts of God. This easement is further contingent upon: (a) Installation of standby generators and additional P, U. D. Loop Power at each pump station located on Lots 13 and 33 of the Plat of Talbot Park, Edmonds, Washington. This is pursuant to a motion passed by Edmonds City Council 9/16/69. (b) Pump Stations on Lots 13 and 33 should not operate until. either standby generators or P. U. D.
