Dear Applicant,
I have reviewed the above building permit application for the Planning Division and it was found that the following
information, corrections, or clarifications will need to be addressed before review can continue:
Critical Areas Checklist:
1. There is no critical areas determination for this property in the system. If you plan to
do any groundwork (like adding a deck) you need to submit a Critical Areas Checklist (enclosed) along with the
$135 review fee and property owner’s signature. Planning staff will review the checklist, visit the site, and
make a determination. If it is found that the site is on or adjacent to critical areas
(wetlands/streams/geologically hazardous areas) then study materials may be required for the construction of
the deck(s). Please turn in the Critical Areas Checklist as soon as possible, because based on current workloads,
they take approximately two weeks to process.
Setbacks:
2. The minimum side setback in the RS-8 zone is 7.5 feet. The proposed new decks are shown at about
3 feet from the south side property line, which does not comply with the zoning code. Please revise plans and
site plan to show that the decks are at least 7.5 feet from the south property line. Please also show an elevation
detail of the decks with height measurements shown. Also, are the decks uncovered and unenclosed? What is
the height of the decks above ground level? You may be eligible for the following code citation (if so, please
show on plans and site plan):
ECDC 16.20.040.C.
Porches and Decks. Uncovered and unenclosed porches,
steps, patios, and decks may project into a required setback not more than one-
third of the required setback, or four feet, whichever is less; provided, that they
are no more than 30 inches above ground level at any point.

sheets only) with a written response to each of the above items. Please make all submittals to the Development
