Dear Mr. Johnson,
I spoke with Al Larson at the counter about the nonconforming building issue on your property

at 233 3 Avenue North, and he was able to provide me with some background on this project. I
then spoke with the Planning Manager, and it seems that all we’re waiting for is documentation
from you illustrating how the garden windows comply with the newly revised ECDC
17.40.020.D.3. This would need to be a site plan or survey with an accurate measurement
showing exactly how far your improvements project into the setback so that we can verify if the
code change was sufficient. Without knowing exactly where the garden windows are at, we
don’t know whether any code adjustments are possible.
Please submit the requested documentation by Wednesday June 17, 2009
. If you feel that the
project will not be able to comply with the new code allowance, please let me know so that we
can establish a workable schedule for the window replacement.
